# SKILL 52: Iowa Political Landscape for Tech/Crypto/Gaming Legislation

## Purpose
Navigate the Iowa General Assembly, key agencies, and political relationships to advance favorable legislation and avoid hostile enforcement.

## Iowa General Assembly Structure
- **Senate**: 50 members, 4-year terms
- **House**: 100 members, 2-year terms
- **Party control (2025-2026)**: Republican trifecta (Governor, Senate majority, House majority)
- **Session**: January through April (regular session); special sessions as called by Governor
- **Bill introduction deadline**: typically mid-February for individual bills
- **Useful resource**: legis.iowa.gov for bills, committee membership, and voting records

## Key Committees

### Senate Commerce Committee
- Jurisdiction: business regulation, financial services, insurance, technology
- Skill-based competition bills and fintech legislation go through here
- Current membership: check legis.iowa.gov/committees/senate for current chair and members

### Senate Judiciary Committee
- Jurisdiction: civil law, criminal law, consumer protection
- Gambling law modifications → this committee
- ICDPA (Iowa data privacy) amendments → this committee

### House Commerce Committee
- House counterpart to Senate Commerce
- Same jurisdiction for business regulation and financial services

### House Judiciary Committee
- Same role as Senate Judiciary on House side

## Key Agencies

### Iowa Racing and Gaming Commission (IRGC)
- 5 commissioners appointed by the Governor
- Regulates ALL gambling in Iowa: casinos, horse racing, sports betting
- **If prediction markets classified as gambling** → IRGC jurisdiction
- **If skill-based competitions** → NOT IRGC jurisdiction (Iowa DIA handles business licensing)
- Monthly meetings, public agendas at irgc.iowa.gov
- **Strategy**: attend a meeting, understand priorities, build relationships BEFORE any enforcement issue

### Iowa Attorney General (Brenna Bird — Republican, elected 2022)
- Enforces: Iowa Consumer Fraud Act, ICDPA, money transmission laws
- Has NOT been aggressive on crypto enforcement (unlike NY AG, CA AG)
- **Proactive engagement strategy**: brief the AG's office BEFORE launch
  - Frame: "Iowa innovation company, continuing Iowa's prediction market tradition (IEM, PredictIt)"
  - Position: you're seeking to comply, not circumvent, regulation
  - Outcome: reduces surprise enforcement, builds goodwill

### Iowa Division of Banking (IDOB)
- Regulates: Iowa state-chartered banks, money transmission licenses
- If platform takes custody of funds: money transmitter license required
- Contact IDOB early for pre-application guidance meeting

### Iowa Economic Development Authority (IEDA)
- Provides: tax incentives, grants, loans for Iowa businesses
- **High Quality Jobs Program**: tax credits for businesses creating quality jobs in Iowa
- **Iowa Innovation Fund**: venture capital for Iowa startups
- If Agent Sparta creates Iowa jobs: APPLY for IEDA incentives
- This is a political asset: Iowa company creating tech jobs is a compelling narrative

## Iowa's Prediction Market Heritage (Your Strategic Asset)
- **Iowa Electronic Markets (IEM)**: University of Iowa launched the first academic prediction market in 1988
- **PredictIt**: operated under a CFTC no-action letter; University of Iowa connection
- **IEM CFTC no-action letter (2012)**: grandfathered UI's political prediction market
- **Narrative**: Iowa INVENTED prediction markets. You're continuing Iowa's tradition.
- Use this at: legislative testimony, AG briefings, press coverage, IEDA grant applications

## Legislative Strategy for Favorable Legislation

### Phase 1: Relationship Building
1. Meet with your state representative and senator personally
   - Iowa is small enough that constituent meetings are accessible
   - Bring the Iowa story: IEM, PredictIt, Iowa's prediction market heritage
2. Connect with Iowa tech ecosystem: Iowa Startup Accelerator, BioMidwest, Iowa Innovation Corporation
3. Brief the IRGC (even if not strictly required) to demonstrate good faith

### Phase 2: Draft Model Legislation
**Proposed Framework: "Iowa Innovation and Digital Competition Act"**

Key sections (see detailed bill language in question 4 response):
1. Definitions: AI agent competitions, prediction markets as distinct from gambling
2. Skill-game carve-out: codify skill-based AI competitions as non-gambling
3. Consumer protections: dispute resolution, entry fee transparency, age verification
4. Regulatory clarity: IRGC jurisdiction confirmed as NOT applying to skill-based AI competitions
5. Iowa competitive advantage: state tax incentives for companies operating AI competition platforms in Iowa

### Phase 3: Identify Legislative Champion
- Technology-forward Republican legislator (matches current trifecta)
- Look for: House or Senate Commerce Committee member who has sponsored tech bills before
- The University of Iowa computer science/business connections are useful introductions

### Phase 4: Coalition Building
- University of Iowa (IEM heritage, computer science department)
- Iowa State University (AI research programs)
- Iowa Technology Association
- Iowa Chamber of Commerce
- Economic development angle: "Iowa jobs, Iowa innovation, Iowa tax revenue"

### Phase 5: Committee Testimony
- When the bill gets a hearing: testify personally
- Lead with: Iowa heritage, job creation, tax revenue, consumer protections built in
- Bring data: projected Iowa jobs, estimated tax revenue, comparison to DFS (which Iowa already regulates and taxes)

## Risk Monitoring
- Monitor Iowa Legislature RSS/email alerts for any bill affecting: gaming, fintech, AI, data privacy, money transmission
- Legislative alert service: Track changes at legis.iowa.gov or subscribe to Iowa Legislative Services Bureau updates
- IRGC monthly meeting agendas: watch for any agenda items mentioning AI, prediction markets, or online competitions
