# HOS 16-Hour Short-Haul Exception (§ 395.1(o))

Property-carrying drivers can extend the 14-hour duty window to 16 hours **once per 7 consecutive days** under **§ 395.1(o)**, but the rule is narrow.

## Eligibility

All four conditions must be met:

1. Driver returns to and is released from the **same** normal work-reporting location at the end of the duty period (the location the driver started from in the past 5 duty periods)
2. The driver was off duty for at least **10 consecutive hours** before the duty period began
3. Driver has not used the 16-hour exception in the prior **6 consecutive days** (so once per 7 days max)
4. Maximum **11 hours of driving** still applies — the exception extends the 14-hour window only, NOT the 11-hour drive limit

## Common mistakes

- **"I returned to my home terminal" ≠ "same work-reporting location."** If a driver alternates terminals across 5 days, the exception doesn't apply.
- **Pre-trip + post-trip on the 16-hour day still count toward on-duty time.** Total on-duty time cannot exceed 16 hours.
- **The exception does NOT pause the 70-hour cycle.** Use of the exception still counts against the 60/70-hour limit.

## Documentation

Driver must note "16-hour exception" on the RODS (Records of Duty Status). ELD systems mark this automatically when configured; paper RODS require manual annotation.

## When NOT to use this exception

- Passenger-carrying drivers — § 395.1(o) does not apply
- Hazmat placarded loads — depends on state restrictions
- When the driver may need it again within the same 7-day window — save it for the day you'll actually need it
