# Medical Variance Application Process

When a driver does not meet § 391.41 standards but believes they can safely operate, the FMCSA Medical Programs Division reviews variance applications.

## Variance types
- **Vision** — common; for drivers below 20/40 acuity
- **Hearing** — common
- **Insulin** — relatively common
- **Cardiac/cardiovascular** — case-by-case
- **Other** — orthopedic, etc.

## Application steps
1. Driver requests application from FMCSA (online or via Medical Programs Division)
2. Driver completes the variance application
3. Driver submits supporting medical documentation
4. Treating specialists provide reports
5. Driver demonstrates 3+ years of safe CMV driving (typical requirement)
6. Application reviewed by FMCSA Medical Review Board
7. Decision letter issued (typically 30-90 days)

## Required documentation
- Application form
- Recent medical history
- Treating specialist's report
- Driving record (3-year MVR for variance applicants)
- Accident history (DOT-recordable + non-recordable)
- Employment history

## Renewal
Most variances require annual renewal:
- New medical examination
- Specialist re-evaluation
- Continued safe driving history
- Updated FMCSA records

## Variance scope
- Variance is tied to the driver, not the employer
- Driver can carry variance across employers
- Each new employer must document the variance in the DQF + Medical Examiner verification

## Compass tracking
- Drivers with active variances
- Next renewal due date
- Specialist visit schedule
- Updated medical exam status post-renewal

## Common pitfall
Carrier hires driver who claims variance but never receives the FMCSA decision letter. Carrier must verify the variance is current — request the letter from the driver and from FMCSA if necessary.
