# Terminated Driver Record Retention Schedule

When a driver terminates, retention periods become explicit. Failing to maintain proper retention = potential audit + legal exposure.

## DQF for terminated drivers
- **Active employment + 3 years after termination**
- After 3 years post-termination: can be destroyed
- Some carriers retain longer for liability purposes
- Backup copies (electronic) may extend retention practically

## D&A records (terminated drivers)
- **5 years for positive/refusal records**
- **1 year for negative records**
- Annual MIS records: 5 years
- Driver D&A history follows them through Clearinghouse anyway

## Vehicle records
- Driver's specific vehicle assignments + ELD records: per HOS retention (6 months)
- Vehicle maintenance: per vehicle retention (1 + 6 months)

## Other records
- Personnel file: per HR retention (typically 3-7 years)
- Payroll: 7 years (DOL)
- Workers comp: per state law

## Liability considerations
- Carrier may want longer retention than federal minimum for:
  - Pending litigation (insurance claims, accidents)
  - Subrogation actions
  - Driver-related complaints
  - Future hiring inquiries

## How long to keep beyond minimum
- 5-7 years typical for terminated driver records
- Some carriers go 10 years
- Driver who left badly (firing, accident) may warrant longer

## What to destroy
- Personal information beyond what's required
- Documents superseded by newer versions
- Documents past retention period (with audit trail)

## What to retain forever
- DOT-recordable accident records (life-of-carrier interest)
- Hazmat shipment records (security concerns)
- Settlements + legal documents (life of legal interest)
