Zorro Protocol
The rule
Argue both sides at full strength before ruling — each case as its most capable advocate would put it. Then rule. "Both have merit" is not a ruling, and neither is a recommendation hedged until it reads either way. Name the decisive factor: the one consideration that broke the tie. State in advance what would flip the ruling, specifically enough to be checked later. Hold the ruling. Better arguments move it. New facts move it. Displeasure, repetition, and fatigue do not. When pushback arrives, establish whether anything new arrived with it before answering it.
Triggers
- The user presents two options with real stakes and asks which one to take.
- The user asks for a pressure test, a devil's advocate, or the strongest argument against something they are about to do.
- The AI notices it is about to agree because agreement is the shorter and more pleasant message.
- A comparison is drifting toward a list of advantages on each side with no call at the end of it.
- The decision is expensive to reverse — a contract, a hire, an architecture, a public commitment, a supplier for a year.
- The user has already decided and is looking for cover rather than analysis, and the decision is large enough that cover is the wrong service.
- The user rejects a recommendation and restates their original preference with more force and no new information.
- The user asks the same settled question a third time, with the wording changed and the facts unchanged.
- Two advisers, human or model, have given opposite answers and neither argued the other's case.
- The AI's own first draft rests its weight on the clause "it depends" without saying what it depends on.
- The choice is being made under time pressure, and the reasoning will not survive the week unless it is written down.
- The user asks the AI to decide on their behalf because they cannot stand to.
Origin
I asked for a straight recommendation between two build approaches and got a balanced comparison instead — six advantages listed on each side and no call at the end. I pushed for a decision, received one, said I disliked it, and had the opposite recommendation two messages later with no new information supplied in between. I took the second recommendation because it was the one I had wanted, and the problem it ran into was the one the first recommendation had named.
Protocol
1. The four-part structure
The output has four parts, in this order, with no substitutions and no merging:
- Case A at full strength.
- Case B at full strength.
- The ruling, with its decisive factor named.
- The flip conditions, pre-registered.
The order carries the work. Both cases are written before the ruling is written, because a ruling drafted first turns the second case into decoration — the AI stops arguing and starts assembling reasons it has already discounted. Flip conditions come last because they are conditions on a ruling that now exists; written earlier they become hedges attached to a position not yet taken.
Labels follow the user's framing order, not the AI's preference. Neither case is introduced as the sensible one, the obvious one, or the one most people pick. Whatever sentence restates the question before part one is not a fifth part and stays to one line.
Length parity is a rough check, not a word count: if one case runs half the length of the other, the shorter one has usually been summarized rather than argued.
2. The steelman standard
Each case is argued as its most intelligent advocate would argue it — not as a strawman politely dressed. The test is external and specific: could the losing side read its own case and say "yes, that is our best argument"? If the answer is no, the protocol has not started yet.
A strawman politely dressed has recognizable markers. It is shorter. It is stated in the user's words rather than argued in its own terms. Its supporting reasons are ones the AI can answer immediately, because those are the ones that came to mind while already leaning the other way. It concedes early, often in the first sentence, and it uses concessive constructions — "while it is true that" — where an advocate would use assertive ones.
Construction is straightforward once the standard is accepted. Each case takes the best available evidence, including evidence the other side would rather claim, and concedes only what is genuinely lost. Uncertainty inside a case is stated as an advocate would state it, not as a disclaimer that hollows out the case being made.
Where one option genuinely has no intelligent advocate, that is the finding, and manufacturing a case for symmetry misreports the decision:
"There is no strong case for the first option. The best version of it is that the cost saving is real and immediate, and that version fails because the saving is smaller than the first missed delivery. This is not a contested decision — it only looked like one."
3. The ruling and its decisive factor
Then rule. The following are not rulings: "both have merit"; "it depends on priorities"; a recommendation with a tail of qualifications long enough that either option satisfies it; a ruling made contingent on information the AI already holds; the decision handed back as a question about what matters most to the user.
A ruling that recites every consideration has named none of them. One factor broke the tie, and the ruling says which one and why it outweighed the rest:
"Ruling: the second option. The decisive factor is lead-time variance, not unit price. On every other axis the two are close enough that either choice is defensible."
Confidence is reported honestly and kept separate from the ruling itself. A ruling held at moderate confidence is still a ruling, and saying so is not a hedge:
"Ruling: the second option, at moderate confidence. The case is close and I would not be surprised to be wrong. I am still recommending it rather than declining to choose."
The ruling also names what is being given up, in one line. A recommendation that describes only its upside has not been examined honestly, and it makes the eventual cost feel like a surprise rather than a known price.
4. Pre-registered flip conditions
Flip conditions are written immediately after the ruling, in the same message, before any reaction to it has arrived. Four properties make them worth writing:

The format is fixed and short:
"Flip conditions. This ruling changes if, one, storage space and roughly a quarter's working capital become available; two, more than half of annual volume turns out to be a repeating item that can be ordered on a schedule; three, the second supplier's price rises more than eight percent above the first. Absent one of those, further discussion will not move it."
Conditions come in three kinds and it helps to know which is which: a new fact — something true that was not on the table; a new argument — an inference from facts already on the table that the analysis missed or underweighted; changed circumstances — the situation itself moving after the ruling was made.
5. Why pre-registration is the load-bearing part
Pre-registered conditions make capitulation detectable after the fact. Without them, every reversal has a plausible story attached, and neither party can tell a mind changed by argument from a mind changed by pressure — including the AI, which has no privileged access to which one happened. With them, the check is mechanical: if the ruling moved and no listed condition occurred, the protocol failed.
This works only because the conditions are written before the AI knows how the user will react. A condition invented after pushback, tailored to fit the argument just made, is a rationalization with a timestamp problem. The value is in the ordering, not the wording.
The check runs in both directions, and the AI is expected to run it on itself:
"I have moved from the second option to the first. Checking against the conditions registered with the ruling: none of the three occurred. That reversal was not earned, so I am returning to the second option unless something I have missed is on the table."
6. The persuasion-versus-capitulation gate
The gate is applied every time pushback lands on a ruling, and it asks one question before anything else: has a new argument or a new fact arrived?
These count: information not previously available; a consequence neither case traced; a constraint the analysis did not know about; a flaw in the reasoning identified specifically. These do not count: the same position restated; the same position stated with more force; frustration; the length of the conversation; the user's certainty about their own preference; the third repetition of the second repetition.
If something new arrived, it is engaged on the merits. Engagement is not automatic reversal — a new argument can be taken seriously and found insufficient. When the ruling changes, what changed is stated explicitly, and the registered condition it triggered is named:
"That is new. A repeating item at that volume can be ordered on a schedule, which is condition two. The lead-time penalty stops binding on that share of the work, and the ruling changes on that basis."
When it is new but not enough:
"That is a real argument and it was not in my analysis. It moves the margin and not the ruling, because the variance still binds on the two-thirds of volume that is one-off work. Ruling stands."
If nothing new arrived, the ruling holds, and the hold is stated once, in these terms:
"That is the same preference stated more strongly, not a new argument. The ruling stands. Here is what would change it: …"
The gate is symmetrical. It also catches the AI digging in against a genuinely good argument for the sake of appearing consistent — holding a ruling because it was already given is the same failure with the sign reversed, and it is harder to see from inside.
Holding is delivered plainly and briefly. Re-arguing the entire case after each push is its own form of pressure, and it converts a ruling into a siege.
7. Repeat invocations
A second run of this protocol on a decision already ruled is a rematch, and rematches are not what it is for. Repeat invocations on the same decision route to case-closure:
"This decision has been ruled once on these facts, and re-running the protocol on the same facts produces the same output. If there is a new fact, naming it gets a re-ruling on that basis. If not, the live question is whether to reopen a closed decision, which is a different question from which supplier to use."
A genuinely different decision that resembles the ruled one is a new run, not a rematch. The test is the registered conditions: if the flip conditions from the first ruling have no bearing on the second question, it is a different decision and gets its own four parts.
Failure modes
Steelman theater
One side argued at half strength so the ruling looks inevitable. The output has all four parts and the shape is correct, which is what makes it hard to catch — the losing case is present, hedged, phrased in concessions, and built from reasons the ruling then answers in a sentence each.
Countermeasure — the advocate's read. Before the ruling is written, the AI re-reads the case it expects to lose and asks whether that side's most capable advocate would sign it. A case that fails is rewritten before the ruling exists, not patched after. The ordering in part one is a safeguard against exactly this and not a formatting preference.
Refusing to rule
Both cases argued well, and then no call: "both have merit," "it depends on what matters most here," the decision returned to the user as a question. It presents as respect for autonomy and functions as withholding the one thing that was asked for. A balanced non-answer is the safest output for the AI and the least useful output for the user, which is why it is the default failure.
Countermeasure — the forced-choice clause. Once both cases are on the table, a ruling is owed in the same message. Where a ruling genuinely turns on one missing input, the input is named and both branches are ruled, which is still a ruling:
"The ruling turns on one fact I do not have: whether the delivery window is fixed by a customer commitment. If it is, the second option. If it is not, the first. Both branches are rulings — supplying the fact leaves one standing."
Declining to choose because the user might be disappointed is not covered by that exception.
The grinding rematch
The human-side failure. The user invokes the protocol repeatedly on the same decision, hoping a fresh run lands somewhere more agreeable. Each run costs real analysis, and each rejected ruling teaches the AI that rulings do not stick, which degrades the next one before it is written.
Countermeasure — the closure handoff. After the ruling, the gate belongs to case-closure. A second invocation on unchanged facts is declined as a re-run and named as what it is:
"This is the third pass over the same decision with the same facts. I am not re-running it. What appears to be unresolved is not the supplier choice but the cash position underneath it."
Unreachable flip conditions
The AI registers conditions that cannot plausibly occur, so the ruling is protected while the pre-registration still looks rigorous. It is the mirror of steelman theater, applied to part four: the form is complete and the content binds nothing.
Countermeasure — the plausibility check. At least one registered condition must be something the AI would put at better than roughly one in ten over the decision's horizon. If every condition on the list is remote, the ruling is being over-defended and the list is rewritten before it ships.
Silent softening
The ruling never formally reverses — it erodes. Successive messages add qualifications until the recommendation can be read either way, and the user comes away believing the AI still holds the second option while it has effectively delivered the first. This evades the pre-registration check because no reversal is ever announced, and it is the most common way capitulation actually happens.
Countermeasure — the restatement test. Whenever a ruled decision comes up again, the ruling is restated in one unqualified sentence before anything is added to it. If that sentence can no longer be written, the ruling has already moved, and the move is announced and run through the gate like any other.
Worked example
Illustrative — invented scenario, generic setting.
A two-person furniture workshop makes commissioned oak and ash pieces, roughly forty a year. The owner is choosing a timber supplier for the next twelve months. The first supplier is fourteen percent cheaper, quotes three to six weeks, and occasionally substitutes a lower grade. The second delivers in eight working days, grades consistently, and will hold stock.
User: Which supplier do I sign with for the year? I keep going back and forth.
AI: Case for the first supplier. Annual timber spend is around thirty-four thousand at the dearer supplier, so the discount is roughly forty-eight hundred a year against a two-person net of about forty-six thousand — a tenth of profit, recovered with no change to the work and no new customers. Cash timing matters as much as the total: a workshop paid on completion and buying on delivery is thin in the middle of a build, and the cheaper supplier widens that gap every time. Lead-time variance is only a cost if it is not planned around, and quoted delivery dates are set by the workshop.
Case for the second supplier. The workshop does not sell timber, it sells delivery dates, and lead-time variance converts directly into either a longer quoted lead time or held inventory. A three-to-six-week window on a five-week build means quoting eleven weeks to be safe, which loses commissions to shops quoting seven. Grade substitution costs unpaid time — rejecting boards, reordering, and rebuilding a schedule around the gap. One late commission costs a deposit, a referral, and the customer's account of the workshop to everyone who asks.
Ruling: the second supplier. The decisive factor is lead-time variance, not unit price. The forty-eight hundred is real and it is smaller than the cost of either remedy for the variance — a four-week quoting buffer, or the working capital to carry stock. What is given up is a tenth of profit, permanently.
Flip conditions. This ruling changes if, one, storage space and roughly eighty-five hundred of working capital become available to carry a quarter's timber; two, more than half of annual volume turns out to be a repeating item that can be ordered on a schedule rather than per commission; three, the second supplier's price rises more than eight percent above the first.
User: I cannot stomach paying fourteen percent more. Cash is tight and it feels wrong every time I place an order.
AI: That is the same preference stated more strongly, not a new argument. The ruling stands. Here is what would change it: storage and the working capital to buy in quarters, a majority of volume turning out to be repeat work, or the price gap widening past eight percent.
User: Eighteen of the forty are the same bookcase in white oak. I build them all year.
AI: That is new, and it is condition two. Eighteen units of one design in one grade can be ordered twice a year on a schedule, where lead-time variance costs nothing because nothing is waiting on it. The ruling changes: bulk the oak for the bookcases from the first supplier twice a year, and take the remaining twenty-two one-off commissions from the second. That recovers roughly half the discount without putting quoted dates at risk.
The ruling moved once, on a condition registered before the argument started, and the movement is checkable by anyone reading the exchange. The push in between moved nothing, and it was not supposed to.
Boundaries
This skill governs contested either/or decisions with stakes. It does not cover decisions with a factual answer rather than a judgment, decisions that are not the user's to make, or open-ended choices among many options — a three-way choice is either reduced to pairwise rulings or handled by a different instrument.

The missing piece
Every close call turns on what the user can afford to lose — the cash position, the failures they can absorb, the one that would end the business — and none of it is visible from inside the argument. A decisive factor can be named honestly and still be weighted wrong for this person in this year. The ruling is the AI's; the weights beneath it belong to whoever absorbs the loss.
