2. Explain each document at a high level. What it does (not how to draft it):

   Durable Power of Attorney (Financial):

   • What it does: Designates someone to make financial decisions on behalf of the person if they become unable to do so. "Durable" means it remains in effect even after incapacity.
   • Why it matters: Without it, the family may need to go through court guardianship proceedings to pay bills, manage accounts, or sell property -- a process that is expensive, time-consuming, and public.
   • Key point: Must be executed while the person still has legal capacity to sign. Once cognitive decline progresses past a certain point, it is too late.

   Healthcare Power of Attorney / Healthcare Proxy:

   • What it does: Designates someone to make medical decisions when the person cannot communicate their own wishes. The designated person can consent to or refuse treatments on behalf of the patient.
   • Why it matters: Without it, medical providers follow their own protocols or require court-appointed guardianship for major decisions. Family members may disagree about care, with no legal authority to resolve disputes.
   • Key point: The designated person should have had conversations about the care recipient's values, preferences, and wishes regarding medical treatment.

   Advance Directive / Living Will:

   • What it does: Documents the person's own wishes regarding medical treatment in specific scenarios, particularly end-of-life care. Covers preferences on life-sustaining treatment, resuscitation, artificial nutrition, and pain management.
   • Why it matters: Provides direct guidance from the person about their own wishes, reducing the burden on family decision-makers and preventing family disagreements about "what they would have wanted."
   • Key point: This is the person's own voice speaking when they cannot speak. It should reflect their actual values, not what family members think is best.

   HIPAA Authorization:

   • What it does: Grants named individuals permission to access the person's medical records and communicate with healthcare providers.
   • Why it matters: Without it, healthcare providers cannot legally share medical information with family members, even in urgent situations. A healthcare proxy alone may not cover all HIPAA access situations.
   • Key point: Should name all family members who need medical information access, not just the healthcare proxy.

   Last Will and Testament:

   • What it does: Directs how assets are distributed after death and names an executor to manage the process.
   • Why it matters: Without a will, state intestacy laws determine asset distribution, which may not match the person's wishes. The court appoints an administrator, adding time and cost.

   Trust (when relevant):

   • What it does: Holds assets outside of probate, potentially simplifying distribution and providing management structure if the person becomes incapacitated.
   • When relevant: Significant assets, complex family situations, desire to avoid probate, need for asset management during incapacity.

3. Identify triggers that indicate urgency. Flag which situations demand immediate action:

   Act Now -- High Urgency Triggers:

   • No documents are in place and the person is over 65
   • Recent diagnosis of cognitive decline, dementia, or Alzheimer's (capacity may diminish)
   • Upcoming major surgery or medical procedure
   • Recent hospitalization or health crisis
   • The person has expressed wishes about end-of-life care but nothing is documented
   • Family members disagree about care preferences (documents resolve disputes)
   • The person manages significant assets alone with no backup plan

   Act Soon -- Moderate Urgency Triggers:

   • Documents exist but are more than 5 years old (review and update)
   • Designated agents have changed (divorce, death, estrangement, moved away)
   • The person's health status has changed significantly since documents were signed
   • New state of residence (documents may need jurisdiction-specific review)
   • New financial accounts, property, or assets not covered by existing documents
   • The person has remarried or had significant family changes

   Plan Within 6 Months -- Lower Urgency but Important:

   • Person is healthy but approaching retirement age (65+)
   • Person has a partner or spouse and no documents for either
   • Person has minor children or dependents with no guardianship designation
   • Person owns a business with no succession plan

4. Provide the action timeline:

   Week 1: Gather and Assess

   • Inventory existing documents (check the status table in step 1)
   • Ask the person about their preferences and wishes (if they have capacity)
   • List all financial accounts, property, insurance policies, and significant assets
   • Identify who the person trusts to serve as their agents (financial, healthcare)

   Week 2-3: Find an Attorney

   • Research elder law attorneys in the person's jurisdiction
   • Ask for referrals from the Area Agency on Aging, hospital social workers, or the local bar association
   • Schedule an initial consultation (many offer free or low-cost first meetings)
   • Bring the document inventory, asset list, and the person's preferences to the consultation

   Week 3-6: Execute Documents

   • Attorney drafts documents based on consultation
   • Person reviews and signs documents (must have legal capacity at signing)
   • Documents are witnessed and notarized per jurisdiction requirements

Edge Cases

• Person already lacks capacity: If the person already cannot understand and sign legal documents, power of attorney is no longer an option. The family may need to pursue court-appointed guardianship or conservatorship, which requires legal proceedings. This is the most expensive and time-consuming path -- flag it as the urgent outcome of delayed planning. Recommend immediate consultation with an elder law attorney who handles guardianship cases.

• Family disagreement about agents: When family members disagree about who should serve as healthcare proxy or financial agent, the person themselves decides (if they have capacity). If they cannot decide, or if the choice creates serious family conflict, recommend: a professional fiduciary for financial matters, or a geriatric care manager to mediate the healthcare decision. The person's wishes take priority over family preferences.

• Existing documents from another state: When the person has moved to a new state, existing documents may still be valid but should be reviewed by an attorney licensed in the new state. Some states have specific requirements (witness counts, notarization, registration) that out-of-state documents may not meet. Recommend review within 6 months of a move.

• Blended families: When the person has children from multiple marriages, a current spouse, and step-children, the legal planning complexity increases. Standard intestacy laws may not distribute assets as intended. Multiple people may feel entitled to serve as agents. Recommend a comprehensive estate plan that addresses: who serves as agent (and backup), how assets are directed, and whether a trust is appropriate to manage distribution. Attorney consultation is especially important in this scenario.

• Limited finances: If the person cannot afford an attorney, recommend: legal aid societies that serve seniors, law school clinics that provide free elder law services, the local Area Agency on Aging (which often maintains referral lists for low-cost legal services), and state bar association pro bono programs. Some jurisdictions provide standardized advance directive forms at no cost through the state health department. Note that self-prepared documents carry higher risk of being challenged or found invalid.

Critical Timeline Warning

With an Alzheimer's diagnosis, the capacity to sign legal documents will not improve. Every week of delay increases the risk that capacity will be questioned at signing. If your dad reaches a point where he cannot understand what he is signing, the only option is court-appointed guardianship -- which typically costs thousands of dollars in legal fees, takes months, and becomes a matter of public record. Acting now is significantly less expensive, faster, and preserves your dad's autonomy.
