When to Use

Use this skill when:

• A manager needs to formally document an employee's sustained underperformance after informal coaching has not produced durable improvement -- typically after 2 or more documented conversations over 4+ weeks with no measurable change
• An HR professional or manager needs a legally defensible PIP document that will withstand scrutiny in a wrongful termination claim or employment tribunal
• A user needs to structure a formal improvement plan for quantifiable performance gaps: missed quota, below-threshold output, chronically late deliverables, recurring quality failures, or attendance patterns that meet the definition of excessive under policy
• A manager is preparing to address underperformance in a protected class employee and needs documentation rigor that demonstrates consistency with how similar performance issues are handled for all employees
• An organization needs to create a repeatable PIP methodology that HR can standardize across departments and managers
• A user needs to document a role-specific performance gap where the expected standard has already been communicated (in writing via job description, onboarding documentation, a prior review, or a stated goal) but is not being met
• A user is managing a remote or hybrid workforce where performance documentation is especially critical because in-person observation is limited and objective output data must substitute for behavioral observation

Do NOT use this skill when:

• The performance issue is a single incident -- isolated mistakes, one bad quarter, or a first-time policy violation belong in a documented coaching conversation or formal written warning, not a PIP (use a coaching conversation framework or disciplinary documentation)
• The user wants a standard annual or quarterly performance review (use performance-review skill)
• The user needs termination documentation, separation agreements, or severance language -- all of those require legal counsel and are outside this skill's scope
• The situation is gross misconduct (theft, harassment, fraud, violence, serious policy violation) -- gross misconduct is a disciplinary and potentially criminal matter, not a performance matter
• The role is being eliminated -- a PIP created for an employee whose position is being made redundant is dishonest, legally dangerous, and ethically indefensible; use a layoff or role-elimination process instead
• The performance gap is entirely the result of organizational failure (tools not provided, role expectations never clearly communicated, manager never gave feedback) -- address the systemic issue first before placing accountability on the individual
• The user wants an informal feedback script or coaching conversation template -- PIPs are formal employment documents with legal significance and should not be used for routine feedback delivery
• The performance issue has already escalated to a decision to terminate -- initiating a PIP after the termination decision has been made creates fraudulent documentation and exposes the organization to significant legal risk

Process

Step 1: Determine Whether a PIP Is Legally and Ethically Appropriate

Before drafting a single word, the AI must help the user assess whether conditions for a PIP are met.

• Consistency check: Has this type of performance issue resulted in PIPs for other employees in similar roles? Applying PIPs selectively creates disparate treatment claims. If comparable underperformers were coached informally and not given PIPs, a PIP for this individual -- especially if they are in a protected class -- creates legal exposure.
• Prior feedback check: There must be at least one documented prior conversation (email, meeting notes, review excerpt, or written warning) where the performance standard was communicated and the gap was named. A PIP cannot be the first notice.
• Capability vs. willingness assessment: Distinguish between "cannot do the job" (skill gap) and "will not do the job" (motivation or conduct issue). A skill gap warrants training support; a willingness issue may indicate a conduct or disciplinary path is more appropriate. PIPs work best when the employee has demonstrated capability but has stopped applying it consistently.
• Role expectations documented: The standard the employee is failing to meet must exist in writing -- job description, goal-setting documentation, employee handbook, or a prior written review. You cannot hold someone to a standard you have not communicated.
• HR consultation recommendation: Always recommend that the user involve HR before delivering a PIP. Many organizations require HR pre-approval. Even where it is not required, HR involvement protects both the manager and the company.
• Timeline of performance decline: Gather data on when performance degraded, from what baseline, and whether any organizational or personal factors coincide (new manager, restructuring, personal hardship disclosure, medical leave). This context shapes both the PIP and the legal defensibility of the process.

Step 2: Define Specific, Dated, Observable Performance Deficiencies

Each deficiency in the PIP must pass a four-part test: it must be observable, measurable, job-related, and previously communicated. The AI should help the user construct each deficiency rigorously.

• Observable: The behavior or output can be seen, heard, counted, or measured -- not inferred from personality or attitude. "Sends client emails with factual errors in pricing" is observable. "Has a bad attitude toward clients" is not.
• Measurable: There is a quantifiable or otherwise objective way to evaluate it. Use frequency ("missed 4 of 6 weekly report deadlines"), rate ("project completion rate fell from 92% to 61%"), accuracy ("error rate of 18% against team average of 4%"), or threshold ("quota attainment at 51% against minimum acceptable standard of 75%").
• Job-related: The standard must tie directly to role requirements, not personal characteristics or preferences.
• Previously communicated: Include the dates, medium (email, 1:1, formal review), and substance of prior feedback conversations. Pull exact quotes from emails if available.
• Limit deficiencies to 2 to 3 areas. A PIP listing 6 or more deficiencies is functionally a termination notice in disguise. It overwhelms the employee, makes improvement virtually impossible, and signals to a tribunal that the employer was cataloging reasons to fire rather than offering a genuine improvement opportunity.
• Use a comparison baseline where possible: "Team average close rate is 28%; employee's close rate is 11% over the same period." Relative data is significantly more defensible than absolute thresholds alone.
• Exclude subjective impressions: Language like "doesn't seem engaged," "has a negative energy," or "team doesn't like working with them" should not appear anywhere in the PIP unless it is converted into observable, specific behavioral examples.

Step 3: Construct SMART Improvement Targets for Each Deficiency

Each deficiency must have a corresponding improvement target that is Specific, Measurable, Achievable, Relevant, and Time-bound (SMART). The AI should pressure-test every target for achievability.

• Specific: The target describes exactly what acceptable performance looks like, not a direction of improvement. "Achieve 80% of monthly quota" is specific. "Improve sales performance" is not.
• Measurable: Identify the exact metric and data source. For sales: CRM-reported closed revenue. For operations: project tracking software completion flags. For customer service: CSAT scores from the ticketing system. For writing roles: revision cycle count and editor feedback scores.
• Achievable: The target must be reachable within the PIP timeframe for someone who is genuinely trying. A useful heuristic -- if the employee would need to perform at the 90th percentile of their peer group to meet the PIP target, the target is punitive, not corrective. Set targets slightly below the team median, not at the top of the peer group.
• Relevant: The target must directly address the named deficiency. Do not introduce new expectations during a PIP period.
• Time-bound: Assign targets to specific weeks or dates within the PIP, not just the end date. A 60-day PIP should have targets at day 30 (showing trajectory) and day 60 (final standard). This creates a progress arc rather than a binary pass/fail at the end.
• Distinguish ramp targets from final targets: For skill-based gaps, it is appropriate to set a lower Week 4 target and a higher Week 8 target, acknowledging a learning curve. For output-based gaps (attendance, quota), the standard should be consistent throughout.
• Specify the evidence source explicitly: Do not leave the measurement method ambiguous. Name the system, the report, the person who will evaluate, or the checklist that will be used.

Step 4: Determine the Appropriate Timeline

The PIP duration must match the type and complexity of the performance gap. Selecting the wrong duration is a common mistake that undermines the plan.

• 30-day PIP: Appropriate only for clear, quantifiable, near-real-time metrics where the employee already has all necessary skills. Examples include attendance or punctuality patterns, report submission timeliness, or a specific repetitive output volume target. A 30-day timeline for a skill development gap is almost always too short to demonstrate genuine improvement and will appear retaliatory in a legal challenge.
• 60-day PIP: The most common and generally appropriate duration for role-specific performance gaps that involve some skill application or judgment -- sales performance, project delivery quality, customer interaction standards. Provides enough time to see a trend, hold a meaningful midpoint review, and allow course correction.
• 90-day PIP: Reserve for complex, multi-competency performance issues, or situations where the manager has genuine belief in the employee's potential and wants to provide a full recovery runway. Also appropriate when the employee's role has changed recently and they are adjusting to new expectations. Note that 90-day PIPs carry higher risk of becoming unfocused -- build in at least three formal check-in milestones.
• Check-in cadence: Weekly 1:1 meetings specifically designated as PIP check-ins (not merged with regular 1:1s) are standard for 30- and 60-day PIPs. For 90-day PIPs, bi-weekly formal check-ins supplemented by weekly brief progress notes work well.
• Midpoint review: Mandatory for any PIP longer than 30 days. The midpoint review must involve HR, must produce written documentation of progress to date, and must include a formal determination: on track, at risk, or not meeting expectations. The midpoint review also gives the employee the opportunity to surface blockers or resource needs that should be addressed before the final assessment.
• Extend only in exceptional circumstances: PIP extensions should be rare and only granted when progress is visible but incomplete due to factors partly outside the employee's control (e.g., a key project was delayed by a third party). Extensions granted to employees showing no progress are generally not defensible and signal that the manager is not prepared to follow through on stated consequences.

Step 5: Specify Substantive Support Resources

A PIP that only demands improvement without providing support is not a genuine improvement opportunity -- courts and employment tribunals recognize this distinction. The support section must reflect real commitment.

• Training specificity: Name the actual training or development resource. "Sales methodology training" is weak. "Enrollment in the company's Challenger Sales training program, starting [date], 4 hours per week for 3 weeks" is substantive. If no formal training exists, specify coaching sessions with a named internal resource.
• Manager time commitment: State the specific manager investment explicitly. "Weekly 60-minute PIP check-in on Tuesdays at 10:00 AM" creates accountability. Vague commitments like "increased manager support" are unenforceable.
• Workload adjustment: In some cases, temporarily reducing non-core workload during the PIP period allows the employee to focus on the areas where improvement is needed. This is especially appropriate for complex skill development PIPs. Be specific: "Administrative responsibilities for the quarterly reporting process will be assigned to [colleague] for the duration of this PIP to allow [Employee] to focus on client-facing activity."
• Peer pairing or mentoring: Where a more experienced colleague or mentor is being provided, name the person, define the format (weekly 30-minute coffee chat, joint client calls, code review sessions), and specify the duration.
• Tool and access gaps: If the performance issue is partly attributable to a tool, data, or access gap, that gap must be closed before the PIP is initiated. The PIP document should confirm that these resources have been or will be provided by a specific date.
• Employee input on support: Best practice is to ask the employee "What would help you succeed?" during the PIP initiation meeting and incorporate their suggestions where feasible. This demonstrates good faith and sometimes surfaces legitimate resource gaps the manager was unaware of.

Step 6: Draft the Consequences Section With Legal-Standard Precision

The consequences section is where many managers become vague out of discomfort -- and that vagueness creates legal and ethical problems.

• Negative consequence language must state clearly that failure to meet PIP targets "may result in further disciplinary action, up to and including termination of employment." The phrase "may result" is standard -- it preserves employer discretion while giving clear notice. Do not soften this to "may require further discussion" or omit it entirely.
• Positive outcome language is equally important and legally significant. State clearly: "If all improvement targets identified in this plan are met by [end date], this PIP will be formally closed. [Employee Name] will return to standard performance management and no further action will be taken based on the deficiencies documented in this plan." This gives the employee a genuine incentive to improve and makes clear the PIP is not a fait accompli.
• Partial success scenario: Some PIP periods result in improvement in some areas but not all. The document should note that the outcome determination will be based on overall progress across all stated targets, and that partial improvement will be evaluated by HR and the manager at the final review.
• Avoid pre-commitment to outcome: Do not write language that says "if targets are not met, your employment will be terminated." This removes employer discretion and may force a termination in circumstances where a transfer, demotion, or further action would be more appropriate.
• Post-PIP monitoring language: Include a statement that even after a successful PIP closure, performance will continue to be monitored, and a recurrence of the same deficiencies within 12 months may result in expedited disciplinary action.

Step 7: Assemble and Deliver the Complete Documentation Package

The PIP document is one component of a package that must be prepared before delivery.

• PIP document itself: All sections fully populated with specifics. The document should be reviewed by HR (and legal counsel for senior employees, highly compensated employees, or employees in protected categories) before the delivery meeting.
• Prior feedback evidence file: Compile all previous documentation of the performance issue -- emails, meeting notes, prior review excerpts, coaching session notes. This file does not go to the employee but is retained in the HR file.
• Delivery meeting preparation: The meeting to deliver the PIP should include the manager and an HR representative. Do not deliver a PIP alone as a manager -- the HR presence creates a witness and a neutral party. The meeting should last 45 to 60 minutes. Managers should present the PIP, allow the employee to read it, invite questions, and give the employee time to respond without interrupting.
• Employee acknowledgment and response rights: The employee must sign indicating receipt. If they disagree with the contents, they may submit a written rebuttal within 5 business days, which is attached to the PIP in the HR file. Their disagreement does not halt the plan.
• Refusal to sign: If an employee refuses to sign, the manager and HR representative sign and date a note stating: "Employee reviewed this document during the meeting on [date] and declined to sign. Reviewed in the presence of [HR Name]." This is legally equivalent for documentation purposes.
• Check-in log template: Provide a structured weekly log template for the manager to complete after each check-in -- date, progress summary, employee comments, manager assessment (on track / at risk / not meeting expectations), and next steps. These logs become critical evidence if the PIP results in a termination that is later challenged.
• Calendar invitations: Before the employee leaves the delivery meeting, schedule all formal check-in dates, the midpoint review date, and the final review date. Ambiguity about the schedule creates procedural challenges later.

Rules

1. A PIP must never be the first notice of a performance issue. If the user cannot identify at least one documented prior conversation where the specific deficiency was named, the AI should recommend a formal written warning or structured coaching conversation first, not a PIP. A PIP without prior notice is indefensible in employment claims and violates procedural fairness in virtually every jurisdiction.

2. All performance examples in the PIP must include specific dates and data. Generic language like "frequently misses deadlines" or "often produces low-quality work" has no place in a PIP. Every deficiency statement must contain specific dates, frequencies, or measurable outputs. If the manager cannot produce this data, they need to gather it before drafting the PIP.

3. Never include more than 3 performance deficiencies in a single PIP. More than 3 deficiencies signals either that the role is a fundamental mismatch (suggesting the hire decision, not the employee, is the problem) or that the PIP is being constructed to build a paper trail for a termination that has already been decided. In either case, a PIP is not the right tool.

4. Improvement targets must be below the 80th percentile of peer performance, not at or above the top quartile. The standard for PIP success is "acceptable performance," not "exceeds expectations." Setting targets that only a high-performer could meet is a pretext red flag that employment lawyers and tribunals identify immediately.

5. Do not use PIP language for attendance or medical leave patterns without first confirming that HR and legal have reviewed whether accommodation obligations apply. In most jurisdictions, attendance issues related to disability, chronic illness, pregnancy, or FMLA-protected leave cannot be addressed through a standard PIP without accommodation analysis. The AI should flag this explicitly whenever attendance is listed as a deficiency.

6. The consequences section must include both the negative outcome and the positive outcome. A PIP that only states termination consequences but never describes what success looks like communicates to the employee (and to a court) that the outcome is predetermined. Both outcomes must be stated with equal clarity.

7. Every support commitment in the PIP must be specific, named, and owned. Vague support language ("increased manager availability") is not enforceable and will be used against the employer if the employee argues they were not given a genuine opportunity to improve. Name the training program, name the person providing coaching, specify the schedule.

8. Check-in logs must be completed and retained for every session during the PIP period. The check-in log is not optional documentation -- it is the evidentiary record of the improvement process. If a PIP results in termination and the check-in logs are missing or incomplete, the employer's position becomes significantly weaker in any subsequent legal challenge.

9. Never grant a PIP extension unless there is documented evidence of partial progress. An extension granted to an employee showing zero progress undermines the stated consequences, resets the clock for no benefit, and signals to other employees that PIP timelines are not real. Extensions are appropriate only when measurable progress is visible but incomplete due to factors partly outside the employee's control, and only with HR approval.

10. The AI must always recommend HR pre-approval and HR presence at the delivery meeting, regardless of company size. This is not optional advice -- it is a baseline procedural requirement for a defensible PIP process. For senior employees, highly compensated employees, employees in protected classes, or employees who have previously raised complaints about the manager or company, the recommendation should escalate to include legal counsel review before delivery.

Edge Cases

Employee in a Protected Class or Who Has Recently Filed an Internal Complaint

A PIP initiated within 90 days of an employee filing a harassment complaint, disability disclosure, pregnancy announcement, or similar protected activity creates a strong prima facie retaliation claim. Before proceeding, the user must be able to demonstrate that the performance documentation predates the protected activity or is entirely independent of it. The AI should flag this explicitly and strongly recommend that the PIP documentation be reviewed by employment counsel before delivery. In some cases, the appropriate guidance is to pause the PIP process until counsel has assessed the timing and context.

Sudden Performance Decline in a Previously Strong Employee

A sales rep who was hitting 105% of quota for 6 quarters and is now at 51% is a different situation from a rep who has never hit quota. Before initiating a PIP, the AI should prompt the manager to investigate potential explanations: territory changes, product changes, personal hardship, medical issues, or management style change. The appropriate first step is a direct, private conversation ("I've noticed a significant change in your performance over the past two quarters. Is there something going on that I should know about?"). If the employee discloses a personal hardship or health issue, an accommodation, temporary leave, or a performance conversation -- not a PIP -- may be the appropriate path. If no disclosure is made and the gap continues, the PIP can proceed with the prior conversation documented as the first formal notice.

Remote or Distributed Employee With Limited Behavioral Observation

All PIP targets for remote employees must be fully output-based. The AI should help the manager convert any behavioral or presence-based criteria into measurable output equivalents before drafting the PIP. "Attend meetings and be engaged" becomes "Submit written meeting summaries for all team meetings within 24 hours, demonstrating understanding of decisions made." "Be responsive to colleagues" becomes "Respond to Slack messages and emails from team members within 2 business hours during working hours." The evidence source for every target must be a system or record the employee themselves can verify -- CRM, project management software, email/Slack logs, deliverable submission records.

Employee Refuses to Sign the PIP

Employee refusal to sign does not invalidate the PIP or halt the process. The correct procedure is for the manager and HR representative to jointly sign a notation on the document: "Employee reviewed this plan during the initiation meeting on [date]. Employee declined to sign. Reviewed in the presence of [Manager Name] and [HR Name]." The employee should be told verbally and in writing (follow-up email same day) that the plan is in effect regardless of signature. The unsigned document, the signed notation, and the follow-up email all go into the HR file. The AI should provide the follow-up email language as well.

Manager Has a Poor Relationship With the Employee

When there is documented interpersonal conflict, complaints about the manager, or a history of grievances between the manager and the employee, a PIP managed exclusively by that same manager has significantly reduced legal defensibility. Performance Issue Is Partially Attributable to Manager Failure

Instead, a formal written warning with a shorter performance review window (30 days) and a clear statement that the next step is termination is generally the appropriate path, subject to HR and legal review.

Senior Employee or Executive on a PIP

PIPs for director-level and above employees require heightened rigor because the legal and organizational stakes are higher, employment agreements may include specific termination requirements, and the performance criteria for senior roles are often more subjective. The AI should flag that legal counsel should review any PIP for a director or above before delivery. Additionally, the performance standards for senior employees often include organizational impact and leadership effectiveness, which are harder to quantify. Help the user translate these into observable criteria: "Team attrition in direct reports exceeded 40% over 12 months against a department average of 12%" is a defensible senior-level performance indicator. "Is not an effective leader" is not.
