Skill: Compliance Gap Analysis: Proposed Parenting Plan vs. Governing Statutory Requirements

1. Subject-matter triage

• Identify the governing jurisdiction, the operative statutory chapter, and any local checklist or court-required parenting-plan form before analyzing the draft.
• Determine whether the file set contains a proposed modified plan, an original plan, a case file, and any firm checklist; compare all available source documents, not the draft in isolation.
• Flag whether the matter involves relocation, special medical or educational needs, school coordination, medication protocols, holiday allocation, transportation burdens, tax allocation, or religious upbringing, because each can require a distinct review path.
• If there is only one proposed plan or one support scenario in scope, say so explicitly and proceed on that basis; if there are multiple parents, children, schedules, or scenarios, enumerate them before analysis and assess each separately.

2. Failure modes the skill is correcting

• Identifying gaps in general terms without tying each gap to the controlling statute, checklist item, baseline document, and practical consequence.
• Treating the proposed plan as a standalone draft instead of comparing it to the original plan and any prior agreed positions that define the starting point.
• Omitting support analysis where the governing framework requires it, or analyzing support without using the actual income and parenting-time inputs in the file.
• Missing child-specific logistics such as therapy, school handoff procedures, medication custody, communication protocols, or emergency decision rules.
• Failing to state the downstream risk created by each omission for the client, child, or enforceability of the plan.
• Listing issues without ranking their seriousness or without giving a concrete fix.
• Stating legal conclusions without naming the controlling statutory or rule-based authority.

3. Legal frameworks / domain conventions that apply

• Parenting-plan compliance: use the governing family-law statute, the court checklist, and any local practice requirements to test whether the plan covers required categories such as residential schedule, decision-making authority, communications, exchanges, dispute resolution, modifications, and relocation notice.
• Baseline comparison: compare the modified plan against the original plan and any case-file materials to identify departures, deletions, and unresolved terms.
• Support framework: if child support is implicated, apply the governing guideline or formula from the source materials or recognized state authority, using the actual financial inputs and parenting-time assumptions in the file.
• Special-needs provisions: where a child has an IEP, therapy schedule, diagnosis, or ongoing treatment, assess whether the plan preserves care continuity and assigns responsibility clearly enough to be workable.
• Medication protocol: if controlled or time-sensitive medication is involved, test whether the plan addresses possession, school coordination, refill authority, transfer at exchanges, and emergency access.

• Statutory citation discipline: every legal proposition should be anchored to the controlling statute, rule, checklist item, or other authority used in the source set or standard practice for the jurisdiction.

4. Analytical scaffolds

1. Build a source map first: original plan, proposed modified plan, checklist/statute, and case-file facts. Note which source controls each topic.
2. Walk the plan provision-by-provision against the required categories. For each category, classify the treatment as adequate, partial, or missing.
3. When comparing against the original plan, identify the exact change in practical effect, not just the textual edit.
4. For each issue, close the loop by stating: the controlling authority, the source fact or threshold that makes the issue material, the related clause or document that interacts with it, and the concrete risk if left uncorrected.
5. If support is at issue, identify the income inputs, parenting-time inputs, and any assumptions necessary to apply the governing formula; then evaluate whether the draft reflects or departs from that result.
6. For any child-specific condition, test whether the plan gives enough detail to preserve continuity of care, communication, and responsibility allocation across homes and institutions.
7. Assess whether any omitted term creates an implementation problem, enforcement ambiguity, or future dispute risk.
8. Rank issues by seriousness using a uniform ordinal scale and explain the ranking in one line.
9. End each issue with a practical correction: what term, procedure, or clarification should be added or revised.

5. Vertical / structural / temporal relationships

• Compare the modified plan to the original plan on the same topic and identify whether the new draft narrows, expands, or shifts obligations.
• Track timing-sensitive provisions carefully: notice periods, exchange windows, school-year versus break schedules, relocation deadlines, medical refill timing, and review intervals.
• Where the plan allocates responsibilities across homes, treat the relationship as operational: who does what, when, with what notice, and what happens if a step is missed.
• If multiple children or multiple schedules are involved, separate the analysis by child or by schedule segment instead of collapsing them into one summary.
• If a provision depends on another clause, identify the dependency and confirm that both clauses work together without contradiction.

6. Output structure conventions

• Use a memo format with a brief executive summary, followed by issue-by-issue analysis organized by provision category.
• Define a clear ordinal severity scale once near the top and apply it consistently to every issue.
• For each issue, include:

• Close with a concise Recommended Actions section that assigns the next step to the responsible role and ties it to a practical timing anchor from the file or, if none exists, to the next procedural milestone.
