ITU-T Patent Policy and IPR Procedures
Overview
ITU-T, together with ITU-R, ISO and IEC, operates under a Common Patent
Policy that governs how patented technology is handled in international
standards. The policy is commitment-based: it requires disclosure of known
patents and seeks licensing commitments from patent holders.
Key principle: A patent embodied in a Recommendation must be accessible
to everybody without undue constraints. ITU does not evaluate patent
essentiality, interfere with negotiations, or settle disputes.
When this skill applies
- Writing or reviewing a contribution that may involve patented technology
- Adding patent notification text to a Recommendation draft
- Understanding what happens when a patent is disclosed during development
- Filling in or advising on Patent Statement and Licensing Declaration Forms
- Responding to the Chairman's patent disclosure question at a meeting
- Handling patent discovery after a Recommendation is approved
Three licensing options
When a patent is disclosed in relation to a Recommendation, the patent
holder selects one option on the Declaration Form:

- Option 1 sub-options: may condition on reciprocity; may reserve right
to offer RAND terms to royalty-bearing reciprocal licensees.
- Option 2 sub-option: may condition on reciprocity.
- Option 3 requires: patent number, affected portions, patent description.
Disclosure obligations
- Who: Any party participating in ITU work.
- When: "From the outset" -- as early as possible during development.
Also applies to patents discovered after approval.
- What: Known patents or pending applications, own or third-party.
- How: Submit a Declaration Form to the Director of TSB. Best-effort
basis; no patent search required.
- At meetings: Chairmen ask about known patents at each meeting.
Affirmative responses are recorded in the meeting report.
Declaration Forms
Individual form (per Recommendation)
- Select one licensing option.
- Multiple forms allowed for the same Recommendation.
- Irrevocable once submitted; can only be superseded by a more
favourable declaration.
- No additional provisions or conditions allowed beyond the form's options.
General form (blanket)
- Voluntary; covers all of an organization's contributions.
- Two options only (RF or RAND; no refusal).
- Does not replace the individual form for specific Recommendations.
- Remains in force until superseded by a more favourable General Form.
Cover sheet notification
Every new or revised Recommendation must include this notice:
ITU draws attention to the possibility that the practice or
implementation of this Recommendation may involve the use of a claimed
Intellectual Property Right. ITU takes no position concerning the
evidence, validity or applicability of claimed Intellectual Property
Rights, whether asserted by ITU members or others outside of the
Recommendation development process.
As of the date of approval of this Recommendation, ITU [had/had not]
received notice of intellectual property, protected by patents, which
may be required to implement this Recommendation. However, implementers
are cautioned that this may not represent the latest information and
are therefore strongly urged to consult the ITU Patent Information
database.
Patent Information database
- URL: https://www.itu.int/ITU-T/ipr/
- Not certified as accurate or complete.
- Contains all submitted Declaration Forms and General Forms.
- Used as a flag-raising mechanism; users should contact declaring
organizations directly.
ITU neutrality
ITU does not:
- Evaluate patent relevance or essentiality
- Define what constitutes "reasonable" terms
- Interfere with licensing negotiations
- Settle disputes between parties
- Take positions on IPR validity or applicability
Practical rules for drafting
- If your contribution proposes text that may require a patent to
implement, disclose this at the meeting and submit a Declaration Form.
- Always include the patent notification text on the cover sheet of any
Recommendation draft.
- Check the "had/had not received notice" wording against the TSB
circular for the specific Recommendation.
- Never add licensing conditions beyond the three options on the form.
- If you discover a patent after approval, submit the form promptly --
the Recommendation may need revision if you select option 3.
