Drafts a NEPA-compliant EIS analyzing environmental consequences of a proposed federal action across all required resource categories and alternatives.

Prerequisites

Gather before drafting:

1. Project identification — title, lead agency, cooperating agencies, NEPA coordinator
2. Proposed action — location, timing, phases, scale, legal authority, required permits
3. Purpose and need — underlying problem, regulatory/policy mandates driving action
4. Alternatives — all considered alternatives, including those screened out with reasons
5. Baseline data — environmental inventories (physical, biological, cultural, socioeconomic)
6. Consultation records — scoping comments, agency/tribal letters, Section 106/Section 7 docs
7. Jurisdiction — US federal; identify agency-specific NEPA implementing procedures

Quick Start

1. Confirm project scope, lead agency, and decision to be made
2. Draft purpose and need — specific enough to bound alternatives without predetermining outcome
3. Develop alternatives array including no-action (forward-looking, per 40 C.F.R. § 1502.14)
4. Catalog affected environment by resource category

Document Structure

1. Project Overview

Table with: project title, lead agency + NEPA coordinator, cooperating agencies and roles, statutory authority, and specific decision to be made.

2. Purpose and Need

• State the problem or opportunity requiring federal action
• Cite legal/policy mandates
• Scope must bound reasonable alternatives without predetermining outcome

Organize by resource category — include only detail needed to understand conditions and trends:

• Physical — geology, topography, soils, minerals, paleontological resources
• Water — surface hydrology, groundwater, water quality, floodplains, wetlands, Wild & Scenic Rivers
• Air — attainment status, applicable SIP requirements
• Biological — vegetation, wildlife habitat, listed species, critical habitat, essential fish habitat, corridors
• Cultural — archaeological sites, historic structures, TCPs, NRHP properties, tribal significance areas
• Human environment — land use, demographics, EJ communities, recreation, visual resources, noise, transportation, treaty rights

5. Environmental Consequences

For each resource category × each alternative, analyze:

• Direct — same time and place as action
• Indirect — later/farther but reasonably foreseeable
• Cumulative — incremental contribution combined with past, present, and foreseeable future actions

Per-resource checklist:

• Intensity, duration, geographic extent
• Short-term vs. long-term; temporary vs. permanent
• Beneficial and adverse effects
• Irreversible/irretrievable resource commitments
• Significance criteria and rationale for determinations
• Scientific uncertainty or incomplete information (40 C.F.R. § 1502.22)
• Conflicts with federal/state/local plans or regulations

6. Cumulative Impacts

• Define geographic and temporal scope with rationale
• Identify contributing past, present, and foreseeable future actions
• Assess whether combined effects exceed resource capacity or significance thresholds
• Address resource condition trends (improving, stable, or degrading)

7. Mitigation Measures

Per resource category, specify for each measure:

• Description — specific and enforceable
• Type — avoid / minimize / rectify / reduce / compensate
• Applicable alternatives
• Implementation — responsible party, timing, method
• Monitoring — verification approach, adaptive management triggers
• Residual impact — what remains after mitigation and why further mitigation is infeasible

Distinguish agency-authority measures from those requiring voluntary third-party action.

8. Consultation and Coordination

• Public involvement — scoping, meetings, comment periods; how input shaped analysis
• Draft EIS comments — substantive comments and Final EIS responses
• Tribal consultation — government-to-government process, traditional knowledge, treaty rights
• Section 106 (NHPA) — status and findings
• Section 7 (ESA) — biological assessment/opinion status
• Other coordination — state/local agencies, other federal consultations

Pitfalls and Checks

• Hard look standard — analysis must reflect rigorous consideration; avoid conclusory statements unsupported by evidence
• Alternatives rigging — courts scrutinize whether alternatives represent a genuine range vs. predetermined outcome
• No-action baseline — must project future conditions, not merely describe current state
• CEQ regulation versions — 40 C.F.R. Parts 1500–1508 were revised in 2020 and 2024; confirm which version applies based on project initiation date
• Significance factors — address both context and intensity per 40 C.F.R. § 1508.27 (verify current section after CEQ revisions)
• EJ analysis — required under E.O. 12898; identify disproportionate impacts on low-income and minority communities
• Plain language — accessible to non-technical public; define terms; use active voice (40 C.F.R. § 1502.8)
• Source documentation — cite all scientific literature, regulatory standards, and monitoring data; unsupported assertions are litigation targets
• Tables and figures — use for spatial, quantitative, or comparative information to improve clarity
