Apply Mill's "one very simple principle" to determine whether society may legitimately restrict an action: the sole end for which mankind is warranted in interfering with the liberty of any individual is to prevent harm to others.
When to Use

Mill's Harm Principle
"The sole end for which mankind are warranted, individually or collectively, in interfering with the liberty of action of any of their number, is self-protection. - Is the harm to legitimate interests or merely to preferences, prejudices, or sensibilities?
Step 3: Distinguish Harm from Offense
Not all unpleasant effects constitute harm:
- Harm = damage to someone's legitimate interests (bodily integrity, property, freedom, reputation based on truth)
- Offense = negative feelings (disgust, disapproval, shock, discomfort)
Mere offense does not justify restriction. We are not so fragile that we require protection from opinions or lifestyles we find distasteful.
Step 4: Assess Necessity
Even if harm exists, restriction may not be warranted if:
- The harm is minor compared to the restriction
- Less restrictive means could address the harm
- The action also produces significant benefits
- The individual consented to the risk
Step 5: Check for Paternalism
Is the restriction truly about preventing harm to others, or is it disguised paternalism—preventing harm to the person themselves?

- Restriction not justified if the conduct is primarily self-regarding, or if the "harm" is really offense, or if the person is being protected from themselves
