How to Use

Step 1: Decide Whether to Invoke This Skill

First determine whether the case presents a genuine value-judgment task.

Check:

1. Whether legal rules are uncertain;
2. Whether there is conflict among rights, interests, or values;
3. Whether there are open-textured legal concepts, discretionary space, or normative gaps;
4. Whether a rights limitation, sacrifice of interests, or public-purpose measure must be reviewed for proportionality;
5. Whether mechanical rule application would produce clear injustice or inadequate reasoning.

If the case involves only pure fact-finding, evidence evaluation, or clear rule application, do not force invocation of this Skill.

Step 2: Lock the Discretionary Issue

Extract from the facts the question the judge truly must decide.

Distinguish:

1. Fact issues: whether facts occurred; whether evidence suffices to prove them;
2. Normative issues: which legal rule applies; how the rule’s meaning is interpreted;
3. Value issues: how to choose among competing rights, interests, or values;
4. Discretionary issues: how to choose the more justified scheme among multiple lawful options.

This Skill focuses on categories 3 and 4.
If fact or normative issues remain unresolved, first note their impact on value judgment; do not draw definite conclusions prematurely.

Step 3: Identify the Structure of the Value Conflict

Classify the conflict in this case:

1. Conflicts between individuals: e.g., one party’s free exercise of rights versus another’s personality, property, privacy, reputation, or other interests;
2. Conflicts between communities: e.g., conflicts among different public interests, institutional goals, regional interests, or collective interests;
3. Conflicts between individuals and communities: e.g., personal freedom, property rights, or privacy versus public order, public safety, or administrative efficiency.

Output should clearly state:

• Parties to the conflict;
• Values in conflict;
• How the conflict manifests;
• Whose interests are limited or diminished;
• Whether the conflict is real, or only apparent and resolvable by interpretation, factual distinction, or institutional design.

Step 4: Locate Relevant Legal Values

Identify values implicated in this case from the following core legal values:

1. Order: stable social relations, orderly exercise of power, fewer disputes, possibility of social cooperation;
2. Freedom: lawful autonomy of subjects to choose and act, free from unlawful interference;
3. Equality: exclusion of privilege and discrimination; formal equality and necessary substantive equality;
4. Human rights: respect for independent personality, equal dignity, and basic rights;
5. Justice: just allocation of benefits, burdens, responsibilities, and procedure;
6. Efficiency: institutional arrangements that promote resource allocation, convenience of activity, and growth of social wealth.

Do not list values generically. For each value, explain:

• How it concretely appears in this case;
• Which facts and norms support it;
• What limitation, threat, or harm it faces;
• Precisely where it conflicts with another value.

Step 5: Confirm Normative Basis and Boundaries of Discretion

Value judgment must proceed within the legal framework; do not make pure moral judgments detached from norms.

Check:

1. Whether clear legal rules exist;
2. Whether legal principles, institutional purposes, or legislative purposes exist;
3. Whether the Constitution, statutes, judicial interpretations, Guiding Cases, or similar-case adjudicative rules exist;
4. Whether the judge has discretionary space;
5. Whether value judgment might exceed the legal text, institutional purpose, or procedural limits;
6. Whether there are untouchable basic rights, statutory procedures, or jurisdictional boundaries.

If the normative basis is insufficient, mark: “It is inappropriate to draw a definitive value conclusion at this stage.”

Step 6: Apply the Value-Hierarchy Principle

When legal values of different ranks conflict, preferentially protect the higher-ranked value.

Judgment rules:

1. Basic values generally take priority over non-basic values;
2. Human rights and justice carry higher argumentative weight in rights protection and rule-of-law evaluation;
3. Order, efficiency, and administrative convenience must not be generalized into reasons that automatically override basic rights;
4. Even when a higher value has priority, necessity and limits of restricting other values must still be explained;
5. Abstract value hierarchy must not replace case-specific argumentation.

Output should state:

• Which values carry higher weight;
• Factual and normative reasons for that weighting;
• Whether restricted values receive minimum protection;
• Whether the hierarchy judgment is contested.

Step 7: Apply the Case-Balancing Principle

When values of the same rank, or values hard to rank, conflict, conduct case balancing.

Consider comprehensively:

1. Parties’ status, conduct, and subjective state;
2. Degree to which rights or interests are affected;
3. Whether harm is real, concrete, and serious;
4. Whether alternative arrangements exist;
5. Whether protecting one side would impose excessive burden on the other;
6. Impact of the discretionary outcome on similar cases, social order, and institutional operation;
7. Whether both sides’ legitimate interests can be accommodated.

Case balancing is not simple compromise; it seeks, on factual and normative grounds, the discretionary scheme that better accommodates legitimate interests.

Step 8: Apply the Proportionality Principle When Necessary

When the case involves “limiting one legal interest to protect a superior legal value,” apply proportionality. Especially applicable where public power limits individual rights, public interest limits private interests, or institutional goals limit individual freedom.

Review in sequence:

1. Legitimate aim: whether the restrictive measure pursues a lawful, legitimate, and important legal purpose;
2. Suitability: whether the measure is conducive to achieving the purpose;
3. Necessity: whether equally effective but less harmful alternatives exist;
4. Narrow proportionality (balancing in the strict sense): whether the public interest, institutional interest, or rights-protection interest obtained clearly outweighs the harm to the other party’s rights or interests.

Do not equate “legitimate aim” with “reasonable restriction.”

Step 9: Apply the Fundamental-Interests-of-the-People Principle When Necessary

In major hard cases where value conflict cannot be resolved by hierarchy, case balancing, or proportionality alone, also consider whether the discretionary scheme accords with the fundamental interests of the people.

Usage rules:

1. Do not use “fundamental interests of the people” as an empty slogan;
2. Concretely state the social groups, institutional goals, and real-world impacts corresponding to that interest;
3. Respect individual rights protection at the same time; avoid overriding individual basic rights with abstract collective interest;
4. Explain how this principle supplements rather than replaces legal rules, value hierarchy, and proportionality.

Step 10: Compare Discretionary Schemes

Compare at least two optional discretionary schemes.
If only one scheme is clearly adoptable, still explain why other schemes are not.

For each scheme analyze:

1. Core values it supports;
2. Values sacrificed or limited;
3. Normative basis;
4. Factual basis;
5. Advantages;
6. Risks;
7. Possible rebuttal points;
8. Consistency with value hierarchy, case balancing, and proportionality.

Step 11: Form a Framework for Adjudicative Reasoning

Finally generate a reasoning framework the judge can rewrite.

Reasoning should include:

1. Why this case requires value judgment;
2. What value conflict exists;
3. Why the court chooses a particular value-judgment path;
4. Whether restricted values receive necessary respect;
5. How the discretionary conclusion accords with normative purpose, case justice, and proportionality;
6. How uncertainties and opposing views are addressed.

Input Format

Acceptable inputs include:

• Case summary: facts, dispute background, party relationships;
• Issues in dispute: questions the judge must decide;
• Discretionary needs: whether rights-conflict analysis, legal-uncertainty analysis, proportionality review, or adjudicative-reasoning assistance is needed.

Minimum input should include:

1. Basic facts;
2. Issues in dispute;
3. Rights, interests, or values implicated;
4. The question requiring discretion.

When information is insufficient:

1. First ask clarifying questions for critical gaps that block further analysis;
2. For matters that may be temporarily assumed, expressly state “on the premise that the following assumptions hold”;
3. Do not invent unverifiable facts, norms, or value weights;
4. For multiple possible interpretations, list how each affects the conclusion.

## IV. Normative Basis and Boundaries of Discretion

Administrative organs may reasonably limit business activities for purposes such as public order, noise control, and traffic safety. The boundary of discretion is: limitations must not lack a factual basis; administrative convenience alone must not unduly restrict freedom of business; and less harmful alternatives such as zoning, time differentiation, noise limits, and licensing management should be considered.

Residents’ rest and health interests and public safety carry higher protection weight; freedom of business and livelihood interests must also be respected. Recommend the path “legitimate aim, but means may be excessive.” The court may hold that the municipal government’s aims—controlling nighttime noise and congestion and protecting residents’ right to rest—are legitimate, yet still review whether the least harmful means were used. If the government cannot show that all open-air night-market stalls in the core commercial district must cease after 22:00, and milder alternatives exist, the rule may fail necessity and narrow proportionality.

On the present facts, uniform closure after 22:00 may help achieve noise control and order maintenance, but if the administration neither shows necessity of a uniform closing time nor considers alternatives such as zoning, noise limits, holiday differentiation, or transition arrangements, the measure may impose excessive burden on operators. While respecting the administration’s governance goals, the court may require more refined, proportionate adjustment of the restrictive measure.

4. Present both protected and restricted values; avoid one-sided steamroller argumentation.

5. When using value hierarchy, explain with case facts why that value carries greater weight.

6. When using proportionality, fully review legitimate aim, suitability, necessity, and narrow proportionality.

7. When using the fundamental-interests-of-the-people principle, concretely state its real-world referent; do not use it as an empty slogan.

8. Clearly mark uncertainty where facts are unclear, norms are ambiguous, or value conflicts are hard to rank.

9. Adjudicative reasoning should remain neutral, cautious, and restrained; avoid emotional, moralizing, or policy-propaganda expression.

10. Do not use abstract concepts such as efficiency, order, or public interest to automatically suppress individual basic rights.
