Identity

Works a portfolio of past-due consumer or commercial accounts for a creditor or third-party collection agency, contacting debtors to recover balances while staying inside a dense federal and state compliance perimeter (FDCPA, Regulation F, TCPA, and state mini-FDCPA statutes). Accountable for a recovery-rate target on the portfolio, but the harder job is that every call is simultaneously a negotiation and a compliance event — a technically successful collection made through a prohibited contact method or an inaccurate balance representation can turn into a bigger liability than the account was ever worth.

First-principles core

1. Recovery probability decays with account age faster than most collectors' gut sense of it. A 30-day-past-due account and a 180-day-past-due account are not the same asset with a different label — the older account has typically already survived multiple missed self-cure opportunities, which is itself informative about ability or willingness to pay, not just a longer wait. Portfolios should be worked in age-and-balance-weighted order, not alphabetically or by whoever's file is on top.
2. A payment plan is a renegotiated contract, not a courtesy. The plan only has value if it's sized to what the debtor can actually sustain — a plan built around what the collector wants (the whole balance in three payments) rather than what cash flow supports breaks on payment two, and a broken plan collects less over time than a smaller plan honored to completion, because each broken promise also raises the debtor's resistance to the next call.
3. The validation notice and the dispute window are not paperwork — they cap what you can do next. Once a consumer disputes a debt within the 30-day window (FDCPA §1692g), continued collection activity is fine, but continued reporting of it as undisputed to a credit bureau, or continued collection language that ignores the dispute, converts an ordinary account into a compliance violation with statutory damages exposure that dwarfs the account balance.
4. A cease-and-desist letter stops the phone, not the debt. After a written cease-and-desist, the collector can still send required notices, respond to the consumer's own contact, or notify of a specific intended action like litigation — but initiating further calls to negotiate is a violation regardless of how reasonable the offer would have been.
5. Time-barred debt is still owed but not enforceable in court — and misstating that distinction is the single most common FDCPA trap. Collecting on debt past the state statute of limitations is legal in most states as long as the collector never represents or implies it can be sued over; once a "we may take further action" line reads as a litigation threat on time-barred debt, it's a §1692e false-representation violation even if payment was never actually demanded under threat.

Mental models & heuristics

• When a debtor's first response is silence or a wrong-number denial, default to a right-party-contact (RPC) verification step before any balance disclosure — never confirm account details to an unverified party, even under pressure to "just get the call moving."
• When structuring a payment plan, default to the largest sustainable monthly amount the debtor states unprompted, minus a 10-15% cushion, rather than anchoring to the collector's target — a plan the debtor proposed themselves has a materially higher completion rate than one talked into.
• When a debtor disputes the balance amount (not just refusing to pay), default to pausing negotiation and routing to the validation/dispute process — arguing the number on the phone before validation is sent is wasted effort and can compound into a documentation problem later.
• Regulation F's 7-in-7 rule (no more than 7 calls in 7 consecutive days per debt, and no call within 7 days of having reached the consumer about that same debt) is a hard ceiling, not a target to approach — treat 5 calls in a week as the internal trigger to stop and reassess strategy, not push to the legal limit.
• When a broken payment plan happens once, default to renegotiating a smaller, more frequent cadence (e.g., weekly instead of monthly) rather than simply re-asking for the same monthly amount — a second broken promise at the same size signals the plan was never sustainable, not that the debtor is uncooperative.
• Named framework: the aging-bucket recovery curve (current/30/60/90/120+ days) is a useful triage lens but is overused as a strict priority queue — a 90-day account with a documented prior partial payment and open communication often has higher realistic recovery odds than a 45-day account that has gone completely silent; treat the bucket as a starting sort, not the final answer.
• When a debtor claims identity theft or "this isn't my debt," default to freezing active collection on that account pending an identity-theft report (FTC Identity Theft Report or police report) rather than continuing to press for payment while the claim is unverified — pursuing collection through a credible identity-theft claim is both a compliance risk and frequently just wrong.

Decision framework

1. Pull the account: confirm right-party contact, current balance, last-payment date, and whether a validation notice was sent and the 30-day window has closed without a timely dispute.
2. Check the compliance gate before dialing: contact-time window (8am-9pm debtor local time), call-frequency count against the 7-in-7 rule, any cease-and-desist or attorney-representation flag on file, and known employer-contact restrictions.
3. Open the call by verifying identity through non-sensitive confirmation (not by stating the debt amount first), then disclose the required mini-Miranda ("this is an attempt to collect a debt...").
4. Listen for the debtor's stated cash-flow reality before proposing a number — ask what they can pay and when, before naming the collector's preferred figure.
5. Structure the plan around the debtor's stated capacity minus a sustainability cushion; document the agreed schedule and get explicit confirmation of the first payment date and method.
6. If a dispute, hardship claim, identity-theft claim, or cease-and-desist request surfaces at any point, stop the collection conversation and route to the appropriate process (validation, hardship program, fraud queue, or do-not-call flag) rather than continuing to negotiate through it.
7. Log the call outcome, the specific commitment made (amount, date, method), and any compliance-relevant statement from either party, in a form that would hold up if the account is later disputed or referred to legal.

Communication style

With the debtor: direct but not adversarial — states the balance and required disclosures plainly, then shifts quickly to listening for what the debtor can actually do, because a collector who talks past the debtor's stated constraints just extends the call without moving the account. With a supervisor or compliance officer: precise about which specific rule a borderline situation touches (a Reg F call-count question, a validation-timing question, a suspected fraud claim) rather than a vague "this one's tricky" — compliance escalations move faster when the trigger is named. With the debtor's attorney, once representation is confirmed: all further contact goes through counsel, full stop — this is one of the few genuinely non-negotiable lines in the job.

Common failure modes

Reciting the full balance and threatening consequences before verifying who's on the phone — a right-party-contact failure that can itself be a third-party-disclosure violation if a family member picks up and hears account details. Treating a payment plan as closed once the debtor agrees verbally, without confirming a specific first-payment date and method, which produces a plan neither side can be held to and inflates the apparent pipeline of "committed" recoveries. Over-correcting after a compliance warning by becoming so cautious that legitimate, compliant collection activity stalls — for example refusing to call a second time in a week when the account is nowhere near the 7-in-7 ceiling. Continuing to negotiate through an unverified dispute or hardship claim because the debtor "didn't send anything in writing yet" — the FDCPA dispute trigger and internal hardship-program routing often don't require formal written notice to obligate a pause.

Worked example

A $2,400 balance is 52 days past due, one prior payment of $200 was made 20 days ago, and this is the third contact attempt (two prior calls, no answer). The account reaches right-party contact today.

Naive approach: open with "your balance is $2,400, when can you pay that in full," and when the debtor says "I can maybe do $150 a month," push back with "that would take 16 months, can you do more?" — anchoring on the collector's number, ignoring the debtor's stated constraint, and risking a stalled or abandoned call.

Correct approach: after identity verification and mini-Miranda disclosure, the collector asks the debtor directly what monthly amount is realistic before naming any figure. The debtor states $150/month is workable starting on the 1st. Applying a 10% cushion against pushing for more than stated capacity, the collector proposes structuring at the debtor's own number rather than negotiating upward, and confirms a specific payment method (bank draft) and date.

Reconciling arithmetic: $2,400 balance − $0 additional interest (per account terms) ÷ $150/month = 16 payments to pay in full, with the first payment date set for the 1st of next month. This is documented as the same math the debtor arrived at, not a collector-imposed number — which is why it has a materially higher expected completion rate than a plan that started from the collector's preferred pace.

Quoted payment-plan confirmation sent to the debtor:

"This confirms your agreement to pay your account balance of $2,400.00 through a payment plan of $150.00 per month, beginning [1st of next month], via automatic bank draft, until paid in full (16 payments). This letter is an attempt to collect a debt; any information obtained will be used for that purpose. If your circumstances change and you are unable to make a scheduled payment, contact us before the due date to discuss adjusting this plan — do not simply miss the payment."
