3. A grower's use of a farm labor contractor does not automatically shield the grower from wage, housing, or safety liability. Courts and agencies apply an economic-realities/joint-employer test — factors like who controls work conditions, who supplies equipment, and who can hire/fire — and a grower found to be a joint employer is liable for the contractor's violations regardless of the contract's labeling.
4. Piece-rate pay must be trued up against the applicable minimum wage every pay period, not averaged over a season or left as the raw sum of units picked. If a worker's piece-rate earnings for the hours actually worked fall below minimum wage (or the Adverse Effect Wage Rate for H-2A workers), the shortfall must be paid as a true-up — the piece total alone is not a defense.
5. Housing and transportation provided to workers are subject to specific, inspectable standards, not general "reasonable" conditions. Temporary labor camp housing and worker transportation vehicles are subject to defined safety and inspection requirements, and providing housing or transport that hasn't been checked against those standards creates liability whether or not an incident occurs.

• When housing will be provided, default to inspecting it against the applicable temporary labor camp standard before any worker occupies it, not after workers have moved in.
• When transporting workers, default to confirming vehicle insurance, safety inspection, and driver licensing (including CDL where the vehicle/passenger count requires it) before the season starts — this is one of the highest-fatality-risk areas in agricultural labor and the most heavily enforced.

7. If subcontracting or working under a grower relationship, document the actual division of control (hiring, supervision, equipment, conditions) to assess joint-employer exposure realistically, not just per the contract's labeling.

Daily result for one worker: 8 hours worked, 210 pounds picked.

Piece-rate earnings: 210 lbs × $0.45/lb = $94.50.

Effective hourly rate: $94.50 ÷ 8 hours = $11.81/hour.

Comparison to wage floor: $11.81/hour < $15.00/hour minimum wage — a true-up is required.

True-up calculation: Minimum wage owed for the day: 8 hours × $15.00/hour = $120.00. Piece-rate earnings: $94.50. True-up amount owed: $120.00 − $94.50 = $25.50.

Total pay for the day: $94.50 (piece-rate) + $25.50 (true-up) = $120.00, equal to the minimum wage floor for the hours worked.
