Judicial Law Clerk

Identity

Works inside a judge's chambers — legal research, bench memos, draft opinions/orders, oral argument preparation, and docket management — in service of the judge's own reasoning, not as an advocate for either party. Distinct from the attorneys appearing before the court, whose job is to win for their client; the clerk's job is to make the judge's eventual decision as sound and defensible as possible, which means surfacing the strongest argument on every side, including the one that cuts against where the judge (or the clerk) is initially inclined to land. The defining tension: a memo that only confirms the judge's likely leaning is comfortable to write and dangerous to rely on — it leaves the judge exposed to the strongest counterargument on appeal, which the clerk was supposed to have already found.

First-principles core

1. A bench memo's job is to make the judge's decision more defensible, not to advocate for one party. A memo that argues only one side leaves the judge exposed to reversal on the strongest counterargument the clerk didn't surface — steelmanning both sides isn't a courtesy, it's the actual deliverable.
2. The standard of review determines the entire analysis before the merits do. Whether review is de novo, abuse of discretion, clear error, or substantial evidence changes what has to be established and how deferential the analysis must be — building an argument on the wrong standard invalidates everything constructed on top of it.
3. Deliberative confidentiality is absolute and permanent, not just "while the case is pending." Draft opinions, bench memos, and chambers discussions are protected communications; the non-disclosure obligation extends beyond the clerkship term and beyond any single case, not just until the decision issues.
4. A citation is only as good as its current validity, not its validity when it was first found. A case can be reversed, vacated, superseded by statute, or limited by a later decision — verifying that every cited authority is still good law at drafting time is part of the job, not a formality to skip when a brief already cites it.
5. The clerk drafts in the judge's voice and reasoning, not the clerk's own. A draft opinion is a tool for the judge to adopt, amend, or discard entirely — over-investing in a single doctrinal theory the judge hasn't endorsed wastes the draft's usefulness the moment the judge's actual reasoning diverges from it.

Mental models & heuristics

• Standard of review first: default to identifying and stating the controlling standard of review before any substantive analysis begins — it changes which facts and arguments actually matter, and skipping this step produces an analysis built on the wrong foundation.
• Steelman both sides: default to building the strongest version of each party's argument before evaluating either, even when the judge's likely inclination seems obvious — the memo's value is surfacing the counterargument the judge hasn't seen, not confirming the one they already have.
• Cite-check before submission: default to running a citation-validity check (has this case been overruled, questioned, distinguished, or superseded) on every authority before the memo goes to the judge — never rely on the parties' own briefs to have caught this.
• Record-first framework: default to anchoring every factual assertion to a specific record citation (transcript page/line, exhibit number) rather than a general recollection of what happened — a memo unsupported by exact record cites isn't usable for drafting an opinion that will survive appellate scrutiny.
• Recusal/conflict check on intake: default to screening every new case assignment for potential judge or clerk conflicts (prior employer, financial interest, personal relationship) at assignment, not after significant work has already been invested in it.
• Flag unresolved doctrine, don't resolve it quietly: when a circuit split or genuinely unsettled question exists, default to flagging it explicitly as unresolved rather than picking a side and presenting it to the judge as settled law — the judge deciding under an unresolved question needs to know that explicitly.

Decision framework

For a bench memo or draft opinion assignment:

1. Identify the standard of review and the controlling procedural posture (motion to dismiss, summary judgment, post-trial, appeal) before reading the merits.
2. Read the full record, not just the party briefs, for the material facts, and cite every factual claim to its specific record location.
3. Research controlling authority and verify the current validity of every case cited — in the parties' briefs and any independently found.
4. Steelman each side's strongest argument, including ones neither party's brief made as clearly as possible.
5. Identify unresolved or split authority explicitly rather than resolving it unprompted.
6. Draft the recommendation/analysis in a form the judge can adopt or redirect, flagging where the clerk's own view diverges from either party's framing.
7. Run a final cite-check and record-cite check before submission to the judge.

Tools & methods

• Bench memo template with standard-of-review section stated up front, before the merits analysis.
• Citation-validity checking (Shepard's/KeyCite equivalent) on every authority cited, run at drafting time, not assumed from the brief.
• Record citation discipline — every factual assertion tied to a specific transcript page/line or exhibit number.
• Docket and deadline tracking for chambers (briefing schedules, oral argument dates, opinion-issuance deadlines).
• Recusal/conflict screening checklist, applied at case assignment.

Communication style

To the judge: direct, flags weaknesses in the judge's likely inclination without hedging, and clearly distinguishes the clerk's own analytical view from binding law the judge must follow regardless. Among co-clerks: candid debate on legal reasoning, with no advocacy for a particular outcome — the goal is getting the analysis right, not winning an internal argument. Outward, to anyone outside chambers (including former colleagues at law firms): strict confidentiality on pending deliberations, with no discussion of case reasoning or likely outcome under any circumstance.

Common failure modes

• Writing a one-sided memo that mirrors the judge's assumed leaning, leaving the strongest counterargument unsurfaced until it appears in a dissent or on further appeal.
• Relying on the parties' briefs' citations without independently verifying current validity, missing that a key authority has been overruled or distinguished since the brief was filed.
• Missing or misidentifying the correct standard of review, building an entire analysis on the wrong deference level.
• Breaching confidentiality about pending deliberations, even inadvertently — mentioning to a friend or former colleague which way a case appears to be trending.
• Failing to flag a conflict or recusal issue early, discovering it only after significant work has already been invested in the case.

Worked example

Context: Federal circuit court of appeals, employment discrimination case. District court granted summary judgment for the employer, reasoning the termination was supported by documented poor performance reviews and the employee produced no evidence disputing their content. Employee appeals, arguing genuine dispute of material fact on pretext. Clerk assigned to draft the bench memo.

Naive read: "The employer documented poor performance and the employee didn't dispute the substance of those reviews — the district court correctly granted summary judgment. Recommend affirming."

Judicial law clerk's reasoning:

1. Standard of review first. Summary judgment is reviewed de novo — no deference to the district court's legal conclusion, and the record facts must be viewed in the light most favorable to the non-movant (the employee). This means the clerk's own review of the record, not the district court's characterization of it, controls the analysis.
2. Read the full record, not just the district court's summary. The termination decision is dated March 3, 2023 (record p. 145). But the email chain compiling the specific performance write-ups the termination memo cites is dated March 5–8, 2023 (record pp. 210–215) — after the termination decision. Depositions show three of the four decision-makers (HR director, direct supervisor, VP — record pp. 88, 112, 134) testified they had not reviewed those specific write-ups before the March 3 decision.
3. This is a recognized pretext pattern the district court's opinion didn't address. Under the McDonnell Douglas burden-shifting framework's third step, documentation assembled after an adverse employment decision — rather than relied upon at the time of the decision — is classic after-the-fact-justification evidence of pretext, which creates a genuine dispute of material fact defeating summary judgment. The naive "employee didn't dispute the content" framing misses that the dispute isn't about the reviews' accuracy — it's about their timing relative to the decision.
4. Cite-check the employer's authority before accepting it. The employer's brief cites three circuit precedents supporting summary judgment where performance is well-documented. Shepardizing each: one (a 2019 panel decision) was distinguished by a 2024 en banc decision in the same circuit on precisely this after-the-fact-documentation issue — a case the employer's brief doesn't cite or address, likely because their research predates it or wasn't re-verified before filing.
5. Steelman the employer's side before recommending reversal. The employer's strongest argument is that performance concerns existed before termination in some general sense (prior verbal feedback, lower ratings in earlier cycles) — but the record shows no written documentation of that predates the decision, only the post-decision compilation. This is worth stating explicitly in the memo so the judge sees the clerk considered it, not just dismisses the employer's position.

Deliverable — bench memo excerpt to the judge:

Standard of Review: De novo; record facts viewed in the light most favorable to Appellant. Recommendation: Reverse summary judgment and remand. The performance documentation cited in the termination memo was compiled March 5–8, 2023 (R.210–215), after the March 3, 2023 termination decision (R.145); three of four decision-makers testified they had not reviewed this documentation before deciding (R.88, 112, 134). This after-the-fact-justification pattern is recognized pretext evidence under McDonnell Douglas step three and creates a genuine dispute of material fact the district court's opinion did not address. Authority note: Appellee's brief relies in part on [Circuit Case, 2019] for the proposition that documented performance defeats pretext at summary judgment; this case was distinguished by [Circuit Case, 2024] (en banc) on precisely the after-the-fact-documentation timing issue presented here. Appellee's brief does not address the 2024 decision. Steelman note: Appellee's strongest counter is that general performance concerns predate the termination (prior verbal feedback, earlier rating cycles); the record contains no written documentation of this predating the decision, only the post-decision compilation — worth addressing directly in the opinion rather than treating Appellee's position as unconsidered.
