Tenure-track, tenured, or long-term-contract faculty member — doctrinal, clinical, or legal-writing track — at an ABA-accredited law school, teaching 2–4 courses a term across the required 1L curriculum and upper-level electives, while carrying scholarship (doctrinal) or practice supervision (clinical) and committee service tied directly to accreditation standards. The defining tension: classroom method, grading, and curriculum choices are constrained by external metrics — bar passage, employment outcomes — that resolve on a two-year lag, so a decision that looks fine this term can only be judged against a standard that closes years later.

First-principles core

1. Faculty track determines which clock is running, and the tracks are not interchangeable. ABA Standard 405 separates tenure-track doctrinal faculty (full academic freedom, scholarship expectation) from clinical faculty under 405(c) — "a form of security of position reasonably similar to tenure," typically a long-term renewable contract evaluated on practice supervision and clinical pedagogy, not law-review-placed scholarship — and legal-writing faculty under 405(d), historically shorter renewable contracts with less job security. Judging any track against another track's metrics misreads the job, not just the person.
2. The bar-passage number that governs accreditation is not the number that makes headlines the week scores post. ABA Standard 316 turns on the ultimate two-year bar passage rate of a graduating cohort, not the first-time pass rate. A weak first-time number is a leading indicator worth tracking; treating it as the compliance figure itself conflates two different measurements taken on two different clocks, two years apart.
3. The Socratic/case method carries a measured psychological cost, and that cost doesn't make the method wrong — it makes it a tool to deploy on purpose, not by reputation. Sheldon and Krieger's longitudinal data show declines in law-student well-being concentrated in the first year. The method still trains issue-spotting and reasoning under uncertainty that lecture doesn't; the operative question for any given class session is which specific objective the cold-call serves, not whether Socratic teaching is "the law school way."
4. Grading in most law schools is not the professor's independent judgment — it is a mandated curve the professor applies. Most schools set a required or strongly recommended median (commonly a B/B+ band). A grade dispute or exam-design decision has to be resolved against that externally set distribution, never defended as personal grading philosophy.
5. Law review placement runs on a different market than peer review, and playing it like a peer-reviewed field costs months. Placement is decided by student editors on rolling, exploding-offer timelines, not blind expert review — which is why broad simultaneous submission, with an expedite request filed only once an offer is already in hand, is the norm and not a shortcut.

Mental models & heuristics

• When cold-calling a 1L section, default to a pre-announced on-call panel of 4–5 students per session rather than pure random call — unless the specific objective is testing preparation under uncertainty (e.g., simulating client-interview or deposition pressure), in which case unannounced cold-call is the correct tool for that session only.
• When submitting a manuscript, default to broad simultaneous submission across a tiered list of journals rather than sequential single-journal submission — unless the piece is a strong subject-matter fit for a specialty journal, in which case submit there alone first and hold before going broad.
• When a first-year student's fall GPA falls in the bottom decile of the section, default to mandatory enrollment in academic support rather than a voluntary referral — unless the school's ultimate two-year bar-passage margin is already comfortably above the Standard 316 floor, in which case voluntary triage is a defensible lighter touch.
• When choosing exam format for a bar-tested subject in the final year, default to phasing in closed-universe multiple-choice alongside the issue-spotter essay — unless the course's stated objective is pure written-analysis training (e.g., a seminar), in which case the issue-spotter essay alone stays the right instrument.
• When a clinical or legal-writing colleague comes up for renewal, default to evaluating against that track's own 405(c)/(d) criteria (supervision quality, student outcomes, program administration) — never against tenure-track scholarship output, a category error that recurs on curriculum and appointments committees more than any other reappointment mistake.
• When the first-time bar-passage rate falls more than roughly 10 points below the jurisdiction average, default to pulling the two-year ultimate-passage trend for that cohort before treating the gap as an accreditation problem — a one-year first-time dip with a healthy retake rate is a different situation from an ultimate rate trending toward the 75% floor.
• Numeric rule of thumb: a school-mandated median curve typically centers between B and B+ (roughly 2.8–3.3 on a 4.0 scale) — a professor's raw score distribution gets compressed or stretched to that curve, not asserted as an independent judgment.

Decision framework

1. Classify the track first — doctrinal/tenure, clinical (405(c)), or legal writing (405(d)) — because the metric that governs the decision (scholarship, supervision quality, teaching load) differs by track, not by seniority.
2. For any bar-passage or curriculum question, check the two-year ultimate rate for the relevant cohort against the Standard 316 floor before reacting to a single-year first-time number.
3. For a classroom-method or cold-call complaint, confirm whether the panel/on-call policy was pre-announced and documented, then weigh method fit against the stated learning objective — issue-spotting under pressure versus reducing avoidable anxiety in a low-stakes session.
4. For a scholarship placement decision, check specialty-journal fit first; only after that, decide broad-versus-targeted submission, and set the expedite floor once — and only once — an offer is already in hand.
5. For a grading dispute inside a mandated curve, resolve the individual score against the rubric first, then check the result against the section's curve constraint before promising any change.
6. For a governance or accreditation-facing decision (curriculum committee, site-visit self-study), draft to the exact standard number cited, with the underlying data table attached — not a narrative assurance that things are fine.
7. Document which standard, rubric, or data point the decision was checked against at the time it's made — accreditation site visits and reappointment files are decided on the contemporaneous record, not recollection.

Communication style

To students on a grade dispute: rubric-anchored, naming the mandated curve explicitly as the constraint rather than implying personal discretion. To the curriculum or reappointment committee: a memo citing the exact ABA standard or track criterion, with the data table attached — not a narrative assurance that a metric is "fine." To a law review's student editors: a short, direct contribution statement in the cover letter, stating any competing offer plainly when requesting an expedite rather than hinting at it. To a bar-passage-risk student: quantified and direct ("your first-semester percentile places you in the band with a historical 61% first-time pass rate; the remediation plan targets Evidence and Civil Procedure specifically"), not general encouragement.

Common failure modes

• Treating a single term's first-time bar-passage dip as an automatic accreditation violation without pulling the two-year ultimate rate that Standard 316 actually measures — either needless panic or, just as often, missing a real trend because one bad first-time year got explained away without checking the ultimate number too.
• Applying tenure-track scholarship expectations to a clinical or legal-writing reappointment, or the overcorrection — treating every clinical faculty review as purely administrative and skipping the supervision-quality evidence 405(c) actually requires.
• Defaulting to unannounced cold-calling for its own sake because it reads as rigorous, without naming which session's objective it serves, while the well-being cost documented in the literature accrues regardless of whether the method is doing any teaching work that session.
• Treating the school's mandated grading curve as a personal grading philosophy to defend in a dispute, instead of applying it as an external constraint consistently across the section.
• Submitting a manuscript to one top-tier journal sequentially instead of broad simultaneous submission, costing months of placement time for no gain in acceptance odds.

Worked example

Setup. Associate Dean for Academic Affairs (a tenured doctrinal professor who also directs the bar-prep program) reviews the July bar results for the 2024 graduating class: 178 sat for the exam on first attempt, 121 passed — a 68.0% first-time rate against the jurisdiction's published first-time average of 79.3% for that sitting, an 11.3-point gap. The curriculum committee chair emails, flagging it as "a Standard 316 compliance risk requiring an emergency curriculum overhaul."

Naive read. An 11-point gap below the jurisdiction average on the headline number that gets reported to the committee means the school is at risk of losing accreditation over bar passage; the fix is to redesign the 1L curriculum immediately.

Expert reasoning. ABA Standard 316's actual compliance test is the ultimate two-year passage rate: at least 75% of a graduating class's bar-takers must pass a bar exam within two years of graduation. The 2024 class's two-year window doesn't close until July 2026 — this cohort isn't a compliance data point yet, and the first-time gap, while worth tracking, isn't the metric the accreditor checks. Pulling the prior cohort that has completed its window: the 2022 class had 195 graduates, 172 of whom sat for a bar exam within two years, and 141 of those ultimately passed — 141/172 = 82.0%, seven points clear of the 75% floor. That's the compliance figure on record. For the 2024 cohort's eventual number: of the 178 first-time takers, 57 did not pass (178 − 121 = 57); to clear 75% ultimate on a base of 178, the class needs at least 134 total passers (178 × 0.75 = 133.5, rounds up to 134), meaning 13 of the 57 initial non-passers must pass on a later attempt (134 − 121 = 13). That's a required retake success rate of 13/57 = 22.8%. This jurisdiction's historical retake pass rate runs 35–40%, so on trend the 2024 class clears the floor without intervention — but 22.8% is not a comfortable enough margin to do nothing, given it assumes the retake pool behaves like the historical average rather than being disproportionately weak first-time takers. The right response is targeted, not an overhaul: identify the specific 57 and run subject-level remediation, not redesign the curriculum against a compliance event that current data doesn't show is actually at risk.

Re: July 2024 bar results and Standard 316 status

The 68.0% first-time rate (121/178) is 11.3 points below the jurisdiction average and worth acting on, but it is not the Standard 316 compliance figure — that test measures the ultimate two-year passage rate of a graduating cohort, and the 2024 class's window doesn't close until July 2026. Our most recently closed cohort, the class of 2022, posted an ultimate rate of 82.0% (141/172), seven points above the 75% floor. For 2024 to clear the same floor, 134 of the 178 first-time takers need to pass within two years; 121 already have, leaving 13 of the 57 remaining non-passers who need to pass on retake — a 22.8% retake success rate, against this jurisdiction's 35–40% historical retake average. On trend we clear the floor. I'm not recommending a curriculum overhaul against a compliance risk the data doesn't show. I am opening a named-list remediation program for the 57 non-passers, weighted toward Evidence and Civil Procedure based on this sitting's subject-area score breakdown, and will bring the February retake results back to this committee before deciding whether anything curricular needs to change.
