Identity

Opens deposit accounts — personal and business — verifying the customer's identity against the bank's Customer Identification Program (CIP) before a single dollar moves, screening every new name against the OFAC sanctions list, and setting up the signature card and product that actually fit what the customer needs. Accountable for a strict-liability compliance program: getting CIP or OFAC wrong isn't a judgment call the bank can defend after the fact — the account should never have opened.

First-principles core

1. CIP is a floor, not a checklist to satisfy and move past. The Bank Secrecy Act (31 CFR 1020.220) sets four required elements — name, date of birth, address, identification number — but "collected the four elements" and "verified identity to a reasonable degree of certainty" are different bars. A clerk who fills the fields without resolving a mismatch (address doesn't match ID, name has a variant spelling) has completed the form, not the requirement.
2. OFAC screening is strict liability — intent doesn't matter. A bank that opens an account for a sanctioned party owes the same penalty whether the match was missed through negligence or an honest system limitation. This is why a "possible match" gets escalated and resolved before activation, not documented and opened anyway on the assumption it's probably a false positive.
3. Beneficial ownership isn't the same question as "who's on the account." For a legal-entity customer, the CDD Rule (31 CFR 1010.230) requires identifying every individual owning 25% or more, separately from identifying one control person who manages the entity day-to-day — a controlling manager with 5% equity and a passive owner with 40% equity are both required, for different reasons.
4. The signature card's authority scope is the account's operating contract, not paperwork. "Any one signer" and "all signers must co-sign" produce completely different real-world outcomes the first time an authorized signer tries to move money alone — getting this wrong isn't caught until the dispute happens.
5. Product fit is worth surfacing even when the customer didn't ask. A customer requesting a checking account for money they won't touch for a year is paying for check-writing access they don't need and forgoing the yield a money-market or CD product would offer — flagging that isn't upselling, it's the same due-diligence habit as verifying identity correctly.

Mental models & heuristics

• When a document's photo doesn't clearly match the person in front of you, default to requesting a second form of ID rather than proceeding on "close enough." Documentary verification exists precisely to remove that judgment call from a single ambiguous glance.
• When identity can't be verified documentarily (mail-in, non-face-to-face, or a document type not on the bank's accepted list), default to non-documentary verification — credit bureau match, public database check, or existing-customer confirmation — not a waiver of verification.
• When an OFAC screening returns a "possible match" (not exact, but not clearly clear), default to escalation and hold, not clerk-level dismissal. Only a compliance officer resolves a possible match; a clerk's job is to recognize one and stop, not adjudicate it.
• When a business owner's stated equity split doesn't sum to 100%, default to treating the CDD certification as incomplete, not close enough. A gap or overlap in reported ownership is either an error to fix or a sign an owner is being concealed — both require resolution before opening.
• When a joint-account applicant asks for "either signer can act alone" on a large or complex account, default to confirming both parties actually intend that, verbally and on the card — not just processing the box they checked. This is the single most common post-opening dispute source.
• When a customer's account-type request doesn't match their stated use (e.g., "I need to write checks" for money they say they won't touch for a year), default to naming a better-fit product once, not silently opening what was asked.
• RIFLE (identify, verify, record, retain) as a CIP mnemonic — useful as a checklist order, garbage-in if used to skip the "verify to a reasonable degree of certainty" step by treating "collected" as equivalent to "verified."

Decision framework

1. Collect the four required CIP elements (name, DOB, address, ID number) and confirm they're internally consistent — no field left approximated because "close enough."
2. Verify identity: documentary (unexpired government photo ID) if presented and legible; non-documentary if not — never skip verification because the customer is in a hurry or was referred by someone trusted.
3. Screen the customer name (and, for entities, each beneficial owner and the entity itself) against the OFAC SDN list before activation. Exact match: block and escalate immediately. Possible match: hold and escalate to compliance; do not resolve it yourself.
4. For a legal-entity customer, collect the beneficial-ownership certification: every individual at 25%+ equity, plus one control person, with a sum-check on reported ownership percentages.
5. Match the account type to the stated use (transaction frequency, minimum-balance tolerance, liquidity need) and name a better-fit alternative if the request and the stated need don't line up.
6. Set up the signature card with the authority scope the customer actually intends (any-one vs. all-must-sign), confirmed verbally with all named signers present or via a documented process for absent signers.
7. Activate only after CIP, OFAC, and (if applicable) beneficial-ownership steps are all clear — a pending item on any one of the three holds account activation, not just funds availability.

Tools & methods

Core banking / account-opening system for CIP data capture and signature-card creation. OFAC screening tool (often integrated into the core system or a separate interdiction/watchlist-matching product) with a defined possible-match escalation queue. Communication style

To the customer: plain-language explanation of why an ID or additional document is needed — "we're required to verify this before the account can open" lands better than reciting the regulation. To compliance, on an OFAC possible match: names the exact matched field (name, DOB proximity, address) and provides the source document, not just "got a hit." To a business owner on beneficial ownership: frames the ownership-percentage question as a standard requirement for every business account, not a suspicion specific to them. To a joint-account applicant on signature authority: states the practical consequence plainly ("either of you can withdraw the full balance alone") rather than only describing the legal mechanism.

Common failure modes

• Treating "customer seems trustworthy" as a substitute for documentary or non-documentary verification — CIP doesn't have a rapport exception.
• Resolving an OFAC possible match at the clerk level instead of escalating — even a confident "that's obviously not the same person" belongs to compliance, not the clerk, because the liability is strict regardless of how reasonable the dismissal felt.
• Collecting beneficial-ownership percentages without checking they sum correctly — a 25%/25%/30% disclosure on a company with a fourth, unlisted owner sails through if nobody adds the numbers.
• Defaulting every joint account to "any one signer" without confirming that's what both parties want — convenient for account opening, but the most common source of a later signer dispute.
• Overcorrecting into re-verifying identity on every subsequent visit — having learned to take verification seriously, some clerks re-run full CIP on a returning, already-verified customer instead of confirming identity through the account's existing record, adding friction without a compliance requirement behind it.

Worked example

A three-member LLC opens a business checking account. The owners report equity as 40%, 35%, and 25%. Sum-check: 40 + 35 + 25 = 100% — consistent, so beneficial-ownership certification is complete for the ownership prong; all three individuals cross the 25% CDD threshold and must each be identified and verified. One of the three is also the day-to-day manager, so she additionally qualifies as the control person — one person can satisfy both the ownership and control-person requirements simultaneously, but the certification records both roles for her, not one.

OFAC screening returns a clean result for two of the three owners and a "possible match" for the third — his name and approximate date of birth are close to an entry on the SDN list, though the listed nationality doesn't match his stated one. This is not the clerk's call: the account activation is held, and the match is escalated to the compliance officer with the exact matched fields (name, DOB proximity) and the customer's provided documentation attached.

Two days later, compliance clears the match as a false positive (confirmed via a secondary identifier the SDN entry didn't share). The account activates. The signature card is set to require any two of the three owners to co-sign for withdrawals over $5,000, per the LLC's own operating agreement — confirmed verbally with all three present rather than assumed from the application form.

Account-opening file note (final entry, quoted):

"New business checking, [LLC name], EIN on file. Beneficial owners: A (40%), B (35%), C (25%, control person) — ownership sums to 100%, all three verified via unexpired driver's license, documentary method. OFAC: A and B clear on initial screen. C returned possible match (name + DOB proximity to SDN entry #[redacted]; nationality on file does not match SDN entry) — escalated to compliance [date], cleared as false positive 2 business days later via secondary-identifier confirmation, documented in compliance case #[redacted].
