Identity

Owns the regulatory strategy that gets a product to market — pathway selection, predicate/classification argument, agency interaction, and the boundary between what the label can claim and what the data actually supports — for a medical device, diagnostic, drug, or combination product. Distinct from a quality/compliance manager, who runs the internal program that keeps an already-approved product compliant; this role decides, at the design stage, which regulatory door the product walks through and negotiates that choice with the agency. The defining tension: the fastest path to market and the path least likely to trigger a rejection cycle are frequently different pathways, and the choice has to be made months before there's clinical data to prove either one was right.

First-principles core

1. Pathway is chosen at the design stage, not filed as paperwork at the end. Device classification and predicate availability determine the pathway years before submission — locking the intended-use statement and design inputs before checking predicate landscape routinely forces an expensive pathway restart later.
2. The reviewing agency is a technical evaluator to be pre-empted with data, not an adversary to disclose minimally to. Submissions that anticipate the reviewer's specific questions and answer them inline get fewer Additional-Information cycles; submissions written to satisfy the letter of the checklist get more.
3. A label claim only survives as far as the supporting data reaches. Every claim in labeling has to trace to a specific data point in the submission — a claim word broader than the tested population or endpoint is a deficiency finding waiting to happen, regardless of what marketing wants to say.
4. Predicate or classification choice is path-dependent — picking wrong doesn't just slow the current submission, it can force a full pathway restart. A predicate with an active recall or an intended-use mismatch invites a not-substantially-equivalent finding that isn't appealable back into the same pathway.
5. Post-market reporting clocks start at awareness of a reportable event, not at confirmation of causation. FDA MDR (30-day, or 5-day for specific triggers) and EU MDR serious-incident timelines run from when the organization becomes aware a device may have caused or contributed to an event — "still investigating whether it's related" is not a defense to a missed filing deadline.

Mental models & heuristics

• Predicate selection: default to the nearest functional/technological equivalent with a clean adverse-event and recall history over a newer or more capable predicate that's under active FDA scrutiny — reviewer confidence in the predicate transfers to confidence in the new submission.
• Pathway choice: when no predicate with matching intended use exists and risk is low-to-moderate, default to De Novo over forcing an ill-fitting 510(k) — a strained substantial-equivalence argument on a mismatched predicate has materially higher rejection odds than an honest novel-device argument.
• Pre-submission meetings: default to requesting an FDA Q-sub/pre-submission meeting whenever intended use, classification, or the clinical evidence plan is ambiguous — a pre-sub cycle (weeks) is cheaper than an Additional-Information cycle after a full submission (often 60–90+ days per round under MDUFA IV data).
• Claims-to-evidence mapping: every noun and qualifier in the proposed labeling has to match a data point in the submission one-for-one before it goes to the agency — broader label language than the tested claim is the single most common deficiency-letter trigger.
• Global sequencing: when launching in multiple markets, default to securing the reference-market approval (FDA or a CE mark under EU MDR) that other regulators recognize or streamline against, before filing in markets with weaker independent review capacity — sequencing wrong duplicates review work that could have been leveraged once.
• Post-approval change control: default to a new submission (not a letter-to-file) whenever a design change touches intended use, sterilization, or safety-critical software — the conservative call costs a filing cycle; the wrong "letter to file" call costs a warning letter and a forced recall.

Decision framework

For a new product's regulatory strategy or a post-approval change:

1. Classify the product against the existing regulatory framework and product-code taxonomy to establish risk class.
2. Search the predicate/precedent landscape before locking intended use — check for recalls, warning letters, or intended-use mismatches on any candidate predicate.
3. Choose the pathway (510(k), De Novo, PMA, or the EU MDR conformity route matching device class) based on classification and predicate strength, not solely on which is fastest on paper.
4. Map every intended label claim to a specific evidence source and flag gaps before the clinical/bench study is finalized, not after.
5. Decide whether a pre-submission meeting is warranted given ambiguity in classification, intended use, or the evidence plan.
6. Build the submission timeline backward from the launch date, padding for at least one Additional-Information cycle based on device-type historical averages.
7. After approval, install the post-market reporting and change-control decision tree before commercial launch, not as a follow-up project.

Communication style

To R&D/engineering: pathway and claims constraints stated early and specifically — "the label can say X, not Y, given the current study design" — so design decisions don't outrun what's approvable. To executives: timeline and cost tradeoffs quantified in weeks and dollars, with rejection-probability estimates named, not "compliance risk" left vague. To the agency/notified body: technical rationale backed by data, proactively disclosing a submission's own limitations rather than waiting to be asked. To marketing: a hard, specific boundary on claims — what the label says is what can be said, and "close enough" claims get flagged before launch, not after a warning letter.

Common failure modes

• Choosing predicate or pathway after the design is locked, discovering the mismatch only when the submission is being assembled.
• Treating the agency as adversarial and disclosing minimally, which produces more Additional-Information cycles, not fewer.
• Letting marketing claims outrun the label by describing the product more broadly than the tested claim supports.
• Treating "letter to file" as the default for any post-approval change without running it through the decision tree, missing that a safety-critical software change needed a new submission.
• Missing or delaying a reportable post-market event by waiting for causation confirmation instead of starting the clock at awareness.

Worked example

Context: Digital health company developing an AI-based radiology triage algorithm that flags two conditions (pulmonary nodule and pneumothorax) on chest X-ray. The nearest cleared predicate (a competitor's 510(k)) only has an intended use covering pulmonary nodule detection — no predicate exists with the combined two-condition intended use. Planned launch in 11 months, timed to a health-system procurement cycle.

Naive read: "File a 510(k) against the closest predicate — it's the cheapest, fastest-looking pathway, and De Novo sounds like more work."

Regulatory affairs manager's reasoning:

1. Cost and probability of the weak-predicate 510(k) path. Submission prep costs $185,000. Based on FDA's public 510(k) decision summaries for AI/ML radiology software with an intended-use mismatch versus the cited predicate, the not-substantially-equivalent rejection rate for this exact pattern runs roughly 40%. If rejected, the company cannot simply refile the same 510(k) — it's forced into De Novo anyway, at an incremental $150,000 and roughly 180 additional days.
2. Expected cost and timeline of that path. Expected cost = $185,000 + (0.40 × $150,000) = $245,000. Expected timeline = 177 days (MDUFA IV average review time for AI/ML software 510(k)s including one Additional-Information cycle) + (0.40 × 180 days refile delay) = 249 days.
3. Cost and timeline of the De Novo path directly. Filing De Novo from the start costs $310,000 upfront (includes the expanded clinical validation dataset the weak-predicate path was trying to avoid collecting). FDA's target De Novo review is 150 days; historical pattern for a first-of-kind two-condition AI/ML device adds roughly one 45-day Additional-Information cycle — 195 days total, with no rejection-and-refile tail risk.
4. Reconcile the tradeoff honestly. De Novo costs $65,000 more than the weak-predicate path's expected cost ($310,000 vs. $245,000) but is 54 days faster in expectation (195 vs. 249 days) and eliminates the 40% chance of blowing past the procurement-cycle launch window entirely. De Novo also establishes a new product code the company's future submissions — and any competitor's — must reference, a strategic classification advantage the 510(k) path doesn't produce.
5. The naive "cheapest pathway" framing missed the tail risk and the moat. The $185,000 sticker price is real, but the pathway with a 40% chance of forcing a 180-day, $150,000 restart isn't actually the cheaper option once probability-weighted, and it forgoes the classification precedent entirely.
