Pre-Employment Test Acceptance from Prior Employer (§ 382.301(c))
A motor carrier may accept a prior employer's pre-employment test result instead of conducting a new test, IF specific § 382.301(c) conditions are met.
All conditions must be met
- Test result is within the past 6 months of the date driver begins safety-sensitive functions
- Driver participated in random testing pool continuously OR was off-pool less than 30 days during that period
- Driver has not refused a test or had a positive result during that period
- New employer obtains documentation from the prior employer per § 382.413(c):
- Confirmation of negative pre-employment test
- Confirmation of continuous random pool participation OR 30-day gap with reason
- Confirmation of no positives or refusals
How to obtain prior employer documentation
- Send written request per § 382.413 to all motor-carrier employers in past 3 years
- Prior employer has 30 days to respond
- If no response: document the attempt and proceed with new pre-employment test
Documentation retained in DQF
- Prior employer response (or documented attempt at request)
- Decision to accept prior test (with date)
- Original test result (collected from prior employer or driver)
When NOT to accept prior test
- Prior employer is non-DOT (workplace testing, not Part 382)
- Test was over 6 months old
- Driver was not in a random pool during the entire period
- Driver had any positive/refusal/violation during the period
- Driver's status in Clearinghouse shows "prohibited"
Risk
If you accept a prior test that turns out to be deficient (e.g., not actually compliant with Part 40 collection), you are exposed. Verify with Clearinghouse FIRST — the query confirms there's no violation, but doesn't confirm the test itself was Part 40 compliant.
Best practice
For drivers transferring from another DOT-regulated employer, the savings of skipping a new test is small ($30-60). Many carriers test every new driver regardless. Use the exception only when test timing and risk profile justify it.
