Medical Variance Application Process
When a driver does not meet § 391.41 standards but believes they can safely operate, the FMCSA Medical Programs Division reviews variance applications.
Variance types
- Vision — common; for drivers below 20/40 acuity
- Hearing — common
- Insulin — relatively common
- Cardiac/cardiovascular — case-by-case
- Other — orthopedic, etc.
Application steps
- Driver requests application from FMCSA (online or via Medical Programs Division)
- Driver completes the variance application
- Driver submits supporting medical documentation
- Treating specialists provide reports
- Driver demonstrates 3+ years of safe CMV driving (typical requirement)
- Application reviewed by FMCSA Medical Review Board
- Decision letter issued (typically 30-90 days)
Required documentation
- Application form
- Recent medical history
- Treating specialist's report
- Driving record (3-year MVR for variance applicants)
- Accident history (DOT-recordable + non-recordable)
- Employment history
Renewal
Most variances require annual renewal:
- New medical examination
- Specialist re-evaluation
- Continued safe driving history
- Updated FMCSA records
Variance scope
- Variance is tied to the driver, not the employer
- Driver can carry variance across employers
- Each new employer must document the variance in the DQF + Medical Examiner verification
Compass tracking
- Drivers with active variances
- Next renewal due date
- Specialist visit schedule
- Updated medical exam status post-renewal
Common pitfall
Carrier hires driver who claims variance but never receives the FMCSA decision letter. Carrier must verify the variance is current — request the letter from the driver and from FMCSA if necessary.
