Defensive Driving Course Requirements
Federal law does NOT mandate defensive driving training for CMV drivers (except for entry-level ELDT requirements). State and carrier requirements vary widely.
What federal law requires (§ 391.11)
Driver must "possess the necessary skills to safely operate a CMV." This is a general qualification, not a course requirement. ELDT (49 CFR Part 380) requires 31 theory + 19 behind-the-wheel topics for first-time CDL applicants — but no recurring federal training.
State-level requirements
- Some states (CA, OH, others) mandate defensive driving for renewal of certain CDL endorsements
- Some states mandate accident-history-triggered training (driver had X+ accidents → required course)
- Hazmat endorsement renewal may require security awareness training
Carrier-level requirements (most common)
- New-hire orientation: typically 2-8 hours
- Annual refresher: 1-4 hours (recommended, not required)
- Post-accident review (if accidents occur)
- Roadside-inspection-triggered: if BASIC alerts, supplemental training
